Pending review by the county / local officials, one step would be to include the neighbor's PE / CE in this episode along with the contractor. Bad thing about mound systems is that they will not last as long as a conventional system and by altering the design as they have, from your description, a blow-out is ~98% guaranteed. Everyone is "on the hook" for this project at this point. The PE/CE who designed the mound, the contractor who installed it, the local health dept and the CE firm that did your stakeout.
In your situation, at this time, I would ask both engineering firms (hopefully, they are two different ones) for a meeting to discuss your options. One being removal / relocation of the mound and the second being a transfer of property lines / land to your benefit.

I didn't think it was gonna go away as easily as you had hoped it might. Kinda like a bad dream. With all the things we seem to deal with in our lives who needs stuff like that.

For all the hassle though I'm glad that things appear to be headed in the right direction. I feel confident that in the long run you'll be glad that you didn't let it go. It also appears that your nieghbor isn't the kind who's relationship with you need to worry about.

Hi rox,

The set back is supposedly 10 feet from the toe (bottom of slope) to the property line. This is what my health department contact is telling me. My neighbor is under the impression that the set back is measured from the top of the slope...this, he says, is what the inspector told him. I don't know what inspector he is referring to as it's the health dept that does the inspection/signs off on the approval.

ST, I think your neighbor had a few too many beers the day the work ws done. He seems to be selling you a line of BS. Hopefully all will work out to your favor in the end. My neighbor battles start tonight.

You know what I think is lost in this whole discussion is the fact that he had 5 acres in which to locate this septic system and he chose to put it within 10 feet of your property line.:rolleyes: Hard to feel sorry for the guy, really.

That is a new discussion for another day. I don't think any body here missed that (he said chuckling). One could speculate all day about why he would have put it there and why he didn't choose one of his other neighbors to screw with. Or for that matter, why he didn't put it somewhere that wouldn't have affected anybody but him.

While not defending the guy, you put a septic system where the ground percs the best. You also put it where it's reachable by a truck when you have to pump it out. There are a number of possible reasons.

Around here when an inground system fails. I have seen them dig out the old system, fill it in with gravel, level off the ground and build the new mound right on top of where the old system went. I think it is quite obvious this guy didn't want to see that ugly mound anywhere near his house. Only he knows why he put it where he did and why he went over the property line. Oh, A mound doesn't need to be pumped. It is a leach field.

I don't recall reading that he can't see it from his house. Perhaps I missed it.
