Neighbour trouble brewing.....?

The OP is in Oz. Slightly different laws. But, your post is spot on :D
Sorry, Robert, I stand corrected. I have a lot of respect for Aussies, who are tough, very resilient and self-reliant people. But every population of humans has it's bell curve, I guess. Lol.

I've witnesses easement issues laid to rest several ways.

Go out of your way to be pleasant/helpful

Buy Out the Easement or the land it's on

Sell and Move Away

Litigation

Wait long enough and one of the parties will die or become senile

Forgot one... by marriage ;-)

This discussion has been dragging on for over a week, and it's becoming pretty obvious that contrary to the considered advice of dozens of TBN members, the OP doesn't want to settle this little problem easily, but instead wants to start a fight to prove a point--what point, I'm not sure, since I don't see he has much of a legal leg to stand on to start with.

Yeah I think you might be onto something here. I'm picking up some kinda attidute in his posts that sure makes me glad he aint my neighbour :D

However, if he'd rather spend $5,000 on lawyers and six months in wasted time, aggravation, travel expense, and court appearances instead of spending an hour setting a $10 post with $2 worth of Quick-set and a gallon of water, more power to him--it's still a free country, I suppose, and it's his money. That will likely turn out to be the most expensive fence post in history.

Sometimes you just gotta shake your head...

I have said in a number of posts that I do not wish to agravate the situation. I have also said that I don't live on the property and would not be there for awhile. How then should I have already fixed the post:confused: as some have suggested. The gate is made of heavy pipe and attached to a post approx 400mm in diameter and in dry clay soil. I am on my own when I visit. I have also said I would assist if he asked and I was there when he was available. I would also risk upsetting the neighbour if the job was not to their liking.

As for being "a difficult neighbour", this is the first issue in 18 years!! I have allowed them to use my land to graze their stock and maintained the road (mowing). I have also propped the post up previously when the post started laying over.

If you think I am difficult, you obviously have not read the issues some others have had! The issue was raised in this forum because of the outright negative response from the wife when I politely asked for something to be done. For daring to ask opinions (and replying to them) I am now the worlds worst neighbour:(

It appears that a lot of the "do it yourself now" reponses have been from people living on their property and can easily arrange a time to do the job. I don't have this situation.

Yep! Don't feel bad, I thought I was polite asking for a "done date" on a neighbours project once.

They went bezerk, and I mean absolute nuclear. I was shocked. They haven't approached me, or ack'd my existance since. Their project now has directly effected my land.
