Jaymar, all I have to add is to make sure the noise is for sure the engine. On HST model tractors, there is a ball checkvalve on top of the HST filter. When the tractor is cold and at low rpm, the ball checkvalve can rattle and tick due to surging fluid. If it is that ball checkvalve, the noise should go away when you rev the engine because fluid flow is constant. Also, you can listen to the top of the filter assy with a stethoscope around the ball checkvalve to hear specific sounds. If you don't have an HST tractor or you are sure the sound is coming from the engine, then this is not possible, but if you have an HST transmission, it is worth a check. The rattling of the checkvalve on tractors with HST is just something that we all get used to.

Yeah, I'd keep the dealer name out for now.
Are there any "lemon laws" that might prevail?
In any event, document everything and email or double-up everything for a paper trail.

I most definitely do have everything documented.... It has such been such a huge hassle. I honestly have no reason to be anything but honest. That is just the kind of person I am.... I have a wife and three beautiful children, I make an honest and modest living, volunteer at a local hospital, etc. I am just an honest, church-going, family man. There really is no other side of the story. The dealer and his mechanic heard the noise and promised it fixed under warranty, but did not follow through. I'm not out to hurt anyone in anyway. All I am asking is for this dealer or New Holland to follow through on their word.... I just want the good running diesel engine the tractor should have, not one sounding like a Chevy 350 starving for oil. I am not list the dealer's name just yet.... My next step is going to be to have a few other diesel mechanics listen to the motor and then go back to the dealer with the reports. I want to avoid all ugliness, even though it will be another out of pocket expense, as well as inconvenient. I just want to stay away from lawyers, even though many people have suggested I contact one... thank you all for your thoughts and opinions and I will keep you all posted! Wish me luck!

Everyone is entitled to make his decision rightly or wrongly. Fair is fair no matter which side benefits. I wish you luck and I'm glad you have everything documented. You're probably dealing with more than one person. I hope at the end all do the right thing and you end up getting what you bought fair and square and everyone is entitled to that.

Have you had the chance to listen to any tractor of the same model? Perhaps the noise is normal for that tractor. I'd be concerned about having them continuously working on it trying to find the problem. Tearing apart a brand new motor my lead to more problems down the road.

No, others of this same model do not sound the same. I was actually told that if there was in fact a problem with the motor, New Holland would replace the entire motor, which I thought was proper. I agree with you on not tearing aprt the motor. When it was in the shop for that month, I was told they were replacing the timing gears. I questioned how they would be doing this without going into the motor itself. At that time, they assured me they would not be going into the motor at all. After I got the tractor back, I noticed the oil pan had been removed by the scratches in the new paint and marks not being lined up... When I called them on this, the salesman told me he had no idea they even went into the motor. Then he told me they just went in to inspect it. This is part of my problem. No one will do anything even though they gave me the supposedly repaired tractor baack and the noise started again... they refuse to even look at it again, even though it is covered by warranty. On top of it , I sent it in with only 53 hours and it came back to me with an additional 10+ hours on it.... Thanks again for your thoughts. And yes, hopefully in the end, all will do the right thing. That's all I'm asking...
