We had a long discussion at work as to how the 15 year old should be punished in the event he is found guilty. There were lots of opinions ranging anywhere from probation/community service to death. Its a tough one.. I remember what I did as a child (15). Some of the stupid things that I have done could have gotten me in big trouble. Luckily no one ever got killed (even hurt). Still this boy is accused of taking the life of a perfectly innocent lady who just came from a short vacation with her family. She was killed in front of her husband and kids. She threatened no one. She probably never even saw that chunk of ice coming. For that the guilty party needs to be punished to the fullest extent of the law....

What do you think the punishment should be if the kid just made a stupid mistake and was sorry (believable) for what he had done?

What about if he admitted wanting to kill or perhaps hurt someone really bad?

I spoke to my sister this evening. She is still very upset about her friend.

No one gets into a car after drinking with the intent of killing anyone....but it happens all too frequently.

It's involuntary manslaughter no matter how you cut it. That should be the charge...let the jury decide if he's guilty. The punishments are already in the statutes, I reckon.

It happened again

Once again, the news stories sicken me.
Some time last month here in Austin. 5 high school kids got a video camera and planned, jack-[censored] style, to find a person on the street and beast them down. They left school and found a 16 year old student waiting for the bus. This student happened to be a speciel ed student who is autistic. They started the camera rolling and commenced to beating him. They got him on the ground and kicked him in the head.
After the beatings, they left and the young man made his own way to a payphone and caledd 911 for assistance.
The disturbing (can you get any more disturbing than the story) is that this happend in an affluent part of the city and at 4:00 pm in the afternoon. The intersection is very busy and the police think bunches of people saw this taking place and NOBODY STOPPED.
The district attorny is persuing this as a hate crime due to the disability of the young man.
Three of the perps were 17-in Texas that makes you an adult. The news has said that the maximum penalty would be two years in jail for targeting a disabled person and taping it while you beat him senseless.
By the way, the police have the vidio and it should give the juries a good feel for who they are dealing with.

If the young man who dropped the chunk of ice can be tried as an adult, he should be. If found guilty he should be detained in a juvenile detention center until he turns 18 and then transferred to a prison to serve out the rest of his life for murder.

He did not accidently drop the ice resulting in the accidental death of the woman. It was his intent to deliberately drop the ice in an attempt to hit the car known to have occupants in it. The fact that he did not think through the end result of his action is irrelevant.

Roy is probably right in his comparison with drunk driving, the boy will get probation and be allowed to drop ice off overpasses until the "3 strikes and you're out" laws take effect.
