It's not that way in Ohio, this is from the DNR website

I have a hard time believeing this. Tresspassing on private property is against the law. Permission to hunt (motorbike, hike, birdwatch, fish, collect leaves, whatever) is not given by default, with the exception being that you need to be told not to tresspass.

"No Tresspassing" is the default condition, with explicit permision being the exception.

I know the laws in Ohio and have hunted there a few times. Ohio has a good setup where the Hunter has to have the landowners written permission to hunt. If caught you will get fined.

You can doubt all you want but in NY if the land is not posted then you can hunt as long as you are not near any houses and such. If the landowners don't want people to hunt on their land they have to post it and or ask the people hunting to leave. I talk to our DEC officers on a regular occasion and am friends with a couple so we do a lot of these type of discussions to see how the rules are in different situations. Even if you post your land but do not post it correctly (if you don't sign your name on the signs it is not legal) people can still go on your land. You can throw them off but can't press charges unless your land is legally posted by the requirements of the DEC. The only exception is if someone is told to leave and that is filed with the DEC/Police and he returns again as you have told him previous to not hunt there. From the New York State Consolidated Laws, Article 11, Title 21, Section 11-2115:

S 11-2115. Posted and unposted lands; failure to leave on request.
1. It shall be unlawful for any person engaged in hunting, trapping or
fishing without permission upon the lands of another, whether or not
posted as provided in section 11-2111 not to leave such lands
immediately when requested to do so by the owner, lessee or lawful
occupant.

This seems ambiguous to me, but it does seem to give permission as the default condition, but you have to leave if requested, whether it is posted or not.

Still a little odd to me that someone can tresspass by default, and you need to make an effort to keep them off your land. /forums/images/graemlins/crazy.gif

What!!!!!!!!!!!!!!!!!!!, You mean that ground that doesnt have buildings on it and yard gnomes isnt there for everyones use for hunting, ATV'ing, garbage dumping, picknicing and getting "back to nature"?????? You mean to say that even if its not in a development it actually belongs to someone???

I guess it is how you are raised or where you are raised. Around here most farmers don't care if you walk or hunt on their land as long as you don't do anything negative. Usually the only people out here that don't want you to even look at their land move here from the citys.

We posted our property but, it's only 11+ acres & I'd really like to know who's around with a rifle. Our house sets more in the middle rather than at the edge of the property. I would let some friends of mine hunt or have access through our property, but only ones that I feel have a clue about hunting safely. I might even be able to get a couple of steaks or maybe some sausage out of the deal.
