This is why I get defensive. I was also told that "in Michigan a hunter can hunt anywhere as long as it isn't posted."

Once I had a chance to look up the actual law I found that it is absolutely not the case. I wonder if your lawyer is saying this to influence you in some way.

I hardly see how you can be responsible for someone else's acts just because you gave them permission to hunt on your land.

Not that it explicitly relates to hunting, posting land to keep people out in general helps reduce liability.
Without going into a tangent, ATV and motorcycle riders can be in issue as well. If they get hurt on your property, you can be liable. Having your land posted "should" reduce the liability (similar to a fence around a pool).

Certainly posting your property is, IMHO, the prudent thing to do.

But in Wisconsin, we have recreational immunity laws . Simply stated, if someone gets injured or causes injury/damage while engaged in a recreational activity, such as riding an ATV, a motorcycle, or even hunting, the property owner cannot be held liable even if the individual had the permission of the property owner to be on the property.

These laws may not apply in the case where a fee was charged, such as at a private hunting reserve, a motocross track, etc.

But the laws were enacted to avoid just exactly the kind of thing that's being discussed - someone getting injured or causing damage/injury.

I like that law!!! Can anyone tell me if PA has a similar law?
I'll still chase them off (on my ATV /forums/images/graemlins/grin.gif) but that would be a law I'd like to see.

Fortunately, I am filthy rich. Oh, wait... I'm just filthy. Your attorney is right that you will get sued. So will the person that fired the shot. So will the manufaturer of the gun, ammunition, the ambulance crew and the doctors that treat the victim, should they survive. Life's full of risks. That's just one I took. I don't blame you for being cautious and it is probably wise advice from your attorney.

It has happened once already in eastern Oregon
A hunter put a bullet thru a house and the neighbors got the bill. You guys remember Oregon is Liberal lawyer town USA.

I just play it safe and dont let anyone hunt on mine.
Our neighbors had one of their long horn bulls shot last year during the season too. /forums/images/graemlins/shocked.gif
So long as there are (snakes) I mean lawyers in this world

Remember, it isn't all the lawyers. There's plenty of decent honest ones. People hire lawyers and juries give out awards, so everyone has a hand in it, not just the attoreys. /forums/images/graemlins/wink.gif

Post you land as you see fit. Its yours, well yours and I'm sure the banks. /forums/images/graemlins/grin.gif I don't worry about p****ssing off the neighbors. Its my land, well mine and the banks. /forums/images/graemlins/grin.gif When the neighbors pay the mortgage, taxes, tractor loan, fuel costs and the other expenses I have for keeping the place up then they can use the land. Until then stay the heck off.

I don't understand people who think just because I have some land, more than they do, that its ok to use my land as they see fit. We don't allow people to enter our house as THEY see fit do we? Why should the be able to use our land? Property is Property.

I have a 5 acres for sale and next to it is another 6 acres owned by some people in New Mexico. The land is posted but some of my signs have been pulled down by tree rats. To make a long story shorter, I reposted when I found corn had been put out as bait for deer season. One of my neighbors who owns 10 acres had invited coworkers to hunt MY land as well as the other 6 acres. Excuse me, you have 10 acres let them hunt YOUR land... At least he was man enough to admit what had happened.

I saw years ago an article which I think was on the NC State Extension website about limiting liability for landowners. The best thing that one could do to limit liability was to post the land. That way someone was tresspassing, i.e., committing a criminal act, and it was very difficult for the landowner to be sued by any thing that the person did or occured to the person while on the landowners property. It make sense. Don't know if it is the same in your state but you would think it would be. See if you state has some information on its websites.

Posting is a two edged sword when it comes to liability.

If you dont post you are allowing tresspassing so its your fault.
If you post, then you were aware of an inherent danger.

Depends on how they pick their lawyer and who appointed the judge.

Solution: open hunting season on lawyers and judges /forums/images/graemlins/grin.gif

In PA. hunting is the ONLY sport that the landowner has any protection from lawsuits. Although it is the safest sport, it is non PC so it gets treated differently.

Since when did common sense and laws have anything to do with one another??
People get sued by the familys of burglers that are killed by homeowners. Wounded and maimed rapists and burglers have been sueing because of loss of ability to generate income for years. Commiting a criminal act doesnt stop the ability to generate a lawsuit.
