I guess that he was concerned that there was a "lookout" for some illegal activity. Otherwise I don't believe there is any regulation in Texas that prevents the use of radios between hunters.

<font color="blue"> Many questions from the peace officer.... Were you alone? (yes sir) --then why do you need the radios?
When did you harvest this animal? (about 5:30) Then what are you doing with this spotlight? ( to help me field dress the animal in the dark)
Now tell me again where is the head..
Why did you cut it off?
on and on and on.

No doubt the warden has seen plenty of truly illegal activities and heard every story and excuse. He has to make a decision on what he sees and hears and determine how to handle each situation. Sounds like he was relatively lenient this time. Like most (and I emphasize most, not all) people in law enforcement they are good people in a dangerous profession doing a good job. My hunting cap off to them.

I got a buck a few years ago. Gutted it, dragged it to the road below after my buddy took my gun and radio up hill to get the truck. As I crossed private property I asked first of the landowners if I could. They said yes and thanks for asking. So I'm at the road. Waiting, waiting, waiting and my buddy is nowhere to be found. So along comes the DEC and he stops. Says nice deer. I say thanks and he says where's your gun? Oh *** here we go.....

So now I'm stripping all my gear off. Checks my gun loads for buckshot ect..... I get a ticket for not "immediately filling out my tag" now mind you it doesn't need to be "on" the deer during transport but the tag needs to be filled out.

The ticket was $250. The max allowed by law but the judge was a crockety old man with a chip on his shoulder.

The DEC by chance was called by someone down the road further who said someone shot a deer on her property and he thought I was the person she was talking about. Wrong place at the wrong time I suppose.

What bothers me is the DEC have no common sense to know right from wrong. You'd think with a little dialogue he might have given you a break. But they don't think that way. Like cops it's the EGO boost they crave for giving you the business.

I think that was uncalled for. The guy was doing his job. How does he know that you purposely didn't fill out your tag? How does he know you weren't going to shoot another deer? You broke the law you got the ticket. Why is that a supposed ego boost for him? He was merely doing his job. I'm not sure why everybody thinks they should get a break when they break the law? It's pretty simple really. Obey the law and you won't have a hassle.

And the funny thing about this thread is that the original poster, Virgil, and apparently his brother, understand what was done wrong, learned from it, have the right attitude, and was just warning others to be sure they know all the rules when they go hunting. /forums/images/graemlins/wink.gif /forums/images/graemlins/laugh.gif And hopefully, if the brother has the right attitude when he goes to see the judge, maybe he'll be a little lenient.

I'm sorry about the fine, but if the warden wanted to push the issue, he could start confiscating things.

The WO's can take sieze the equipment used to comment the wildlife violation.

I know of a man in Florida who took more Lobster than he should as well as being too small. He was caught at the boat ramp. This guy had dozens of small lobsters.

The WO's siezed, his boat, trailer, truck, and scuba gear.

Gonna do the crime be prepared to do the time...

Later,
Dan
