Is the property currently available to be purchased & if so is it fair market value or anywhere close? I agree with those that say purchase if at all possible. If not, I'd stay on your own property or as close to the line as is feasible & don't look back.
The idea of a neighbor fencing his land & approaching me with a portion of the expense is interesting. I don't think I'd be reaching for my checkbook too quickly.

Todd, the best thing to do is go to the town hall and chat with the Code Enforcement Officer. He/she will know the details of any fence ordinance in your town/county. Here in Limington, the zoning ordinances are online and you can look it up yourself.

To all those that don't like the idea of shelling out half the cost for a fence on a property line then move back to the city! Yes, it is blunt and harsh but that is part of living in the county. You have just as much responsibility to keep livestock in or out as the guy next door.

As for the orginial question. Couple things may be the problem. One as someone else already said could be he just does not want to deal with the fence. Two and very much more likely if he was to agree there may be a law that would allow you to take ownership of that small piece after X number of years. My Aunt is in this type of problem now where the fence is past the property line (on her side) she has been paying taxes on it all these years and the other side has been using/maintaining it all these years. A fence line is strong when it comes to that many years and the law.

I don't like the laws and I have always lived in the country so I can't move back to the city. If its your stock then its your responsibility to contain them not mine. same as letting your dog run loose, why should i put up a fence to keep the dog off of my property.

Depending on the state you live in the laws vary. In many states I can drive my cattle across your land, they can eat your grass, and they can graze your fields in the process, IF YOU DON'T FENCE THEM OUT.

what state or states would that be? If thats the case I don't need to buy property I can just take my cattle for a slow drive over the neighbors land and feed my cattle. aint life great.

And there are provisions in each state laws (at least in mine) for declaring your property "open". Meaning you don't have to deal with the fencee. <- Person putting up the fence. Not a typo. /forums/images/graemlins/grin.gif

I am replying to myself because I wanted to respond to som many of you.

MikePA - God I wish I could buy it now (can't afford it) but that would put my PT purchase at least 3 years down the road /forums/images/graemlins/frown.gif

Shul73 - List price is more than double market values and surrounding, like property. has been n the market ofr years and they won't budge. i guess they know what # they want and will just wait 'til inflation or value increases the price.

Riptides - Except for that whole "breast implant class-action thing" I wish I was related to Dow/DuPont. I am just a simple country pharmacist who tries not to let volumes of scientific data get in the way of good common sense

Lazy - regarding fencing requirements, It depends on wether you are in a open or closed range area. Breifly, Open Range = a persons livestock can roam wherever and you ARE required to fence them out...Closed Range = livestock owner is required to fence them in. Discussed in pretty good detail in that link you provided.
