I tried to dump some broken up asphalt at the local landfill and they said it was hazardous waste and would not take it. go figure...I guess maybe it is only considered inert if used on a govt project. But maybe a different story for an individual.

I said the tack coat was inert.. not the asphalt. However, that said.. I've seen lots of differences from county to county, and state to state.

For instance.. here in marion county florida, you can dump crushed concrete, asphalt, terra cotta, glass and iron in a C&D pit ( unlined Construction Debri pit. No vegitation.. though wood can go in. Shingles are iffy and depend upon composition.

I have heard of some states not allowing asphalt into landfills or C&D pits.

I know it is not used oil but there is no way on earth that that fluid is ok for the ground. As I am sure the MSDS sheets say it is only a 0 or 1 but 30 years of breathing or "in contact" with you, then ya die of some weird thing....

I know we had this chemical for cleaning inside some military engines. Then about 6 years ago you could not go within a certain distance of the machine without a "special suit". But it wa sok for the 24 hours shifts at work though....


I re-did my roof last month & my shingles are hazardous material now. BUT up until 8-years ago they were not.....sure ok...

This pointless law is about as good as the "it is known to the state of California to cause cancer"....but the other 49 states are ok...

The government are the biggest “dumpers” out there.

It is just a matter of time before they say, "airplanes are the cause of this and that". They will be toxic someday, just wait.

Yes, I've heard that many times, but it either isn't true, isn't enforced, or widely ignored, or all three.

Yeah, I know it's not used motor oil they spray on the roads...

Yes.. a long time ago.. I know plain used oil was put down as a dust control method... those are bygone days. There are newer dust control oils that are still sprayed in some areas. We often bid on that kind of work near our local municipal airport.

However.. the black fluid that goes down on a road prior to paving or chipsealing is not used motor oil. It is a bituminous asphalt emulsion. Generally refered to as 'prime' or 'tack' coat.. and goes by the trade name 'special MS' depending on the refinery you get it from. It is a material similar to tar that is heated and mixed with water.. up to 50%, and then sprayed down on the finish grade to help with asphalt adhesion. In cases where paving is not immediate, it is often sanded to give it a less sticky surface so traffic can continue driving over the unpaved subgrade. This material is also applied between layers of slag on chip sealed and slag-gravel roads... again.. it isn't used motor oil. I work for a GC.. we build roads.. I can fax or email anyone who disputes this the MSDS that we get from the asphalt company. By the way.. this stuff is considered environmentally inert once cured. It also doesn't require hazmat tags and plaques to haul it in the emulsion form.

I've hauled a bit of that nasty stuff....it's hauled hot in an insulated tanker. And guess what we used to flush out the paddle pump, hoses, and lines when through pumping it off? #2 diesel, which went right into the tank in which the load of road oil was just deposited.

Where did that diesel go when the road oil went on the ground?

Not to be 'smart' here.. but you can'tblame the 'product' for 'bad' handling practices.

Our prime trucks have built in diesel or propane heaters. That includes a propane hand torch for heating up the spraw bar. No need to drain the fold out distribuitor paddles or the spray wand.

Most of the trucks I see around here that are 2000gallons or less use this method ( self heating) I have however seen the asphalt company using a bulk tractor/trailer and putting it down from there.. I'm guessing the distribuitor paddles probably do need to be flushed with something.. however that flush should be collected and disposed of properly...

Yep.. state to state.. solid waste laws are different. I think it has more to do with politics than science.

Well, you convinced me. I'm definitely not going to put used asphalt in my diesel tank!! /forums/images/graemlins/grin.gif

BTW, my local Wallyworld has never complained when I've showed up with 50 or 60 gallons of used motor oil in 5 gallon buckets. They have always let me empty my containers there.
