I looked up the ordinance. Here is the wording. As with any, if fireworks are going off, it's easy to cite the property owner then let them pay the money and expense to go battle that they had no idea who was going to do what.

“Host,” as it relates to this ordinance, means a person who knowingly permits or allows fireworks to be lit, exploded, or sold on private property owned or controlled by the person, and the person knows or reasonably should have known that the fireworks would have been lit, exploded or sold.

Q- if you own 500 acres of land that is unfenced, should you "reasonably know" someone might walk onto it and light off fireworks?

Well, there goes due process and presumption of innocence again ..... I've never heard of a "social host ordinance"-- but apparently Sacramento County, CA has passed one.

"As illegal fireworks for yet another year lit up the sky over the Sacramento region on the Fourth of July, first responder agencies reiterated their intention to issue harsher fines.

Due to a countywide social host ordinance, if it was done in front of your property, you are responsible for it no matter who was lighting it off."

It's "free" for the muni PD or Sheriff to write a citation. But gets quite expensive trying to go to court and overturn against a presumption of guilt by being the landowner.

Reminds me of a husband and wife and son concrete contractor.

They got stiffed by a developer who filed Bankruptcy but failed to name them.

The wife was so upset and with broken English vowed to collect.

She filed in court and won... then she renewed the judgement and years later did collect plus interest.

She said no one disrespects the hard work of my family...

From what you describe, best way to get a response from the authorities is to put trash in the recycling bin (or vice versa).

It’s been a few weeks since hundreds of State Police surged into the area at the direction of the governor.

It’s making a difference and the presence is very noticeable.

One of the recommendations from the State to the City is to amend pursuit rules.

Unless a gun or violent crime it is OPD policy not to pursue.

State police say law breakers know that seldom does anything happen for property crimes which is exactly what the public has been saying…

Brief history:

1. DUI police roadblocks/checkpoints were originally considered illegal search and seizure ....
2. At first, police agreed to only do them on Thanksgiving and Christmas holidays, and publicize the locations in advance in the media, and offer "escape routes" for people not wanting to be checked.
3. The checkpoints, over time, expanded to more weekends and are now any time of the year, day, night, whenever. They are now a frequently used tactic.
4. The escape routes were taken away. Drivers are now forcibly detained out of traffic into a line awaiting being checked by police. Come around a corner-- wham-- you are in a police checkpoint.

This new blockade is the first I have heard of "driver license checks" being added to DUI. What is next-- having to explain why you are in the area at all? Why are the neighbors children in the car with you? Pulling your child aside and away from the parent to check for injuries, ask if the parent is abusive, or ask if they have been gender shamed at home?

I am a strong supporter of law enforcement. And a stronger supporter of not losing constitutional rights against illegal search and seizure. We are losing such rights in CA.

I'm curious as to specifically where they decide to do this. GV CHP covers a pretty big area. Something like this I have mixed feelings on. The old give an inch and they take a mile concept says I should be fully against it. But going after drunk drivers and others who shouldn't be operating a vehicle is more useful than a speed trap. This isn't quite the same as them kicking your door down for no reason, but yeah it does create a situation ripe for over-reach. And like you, I generally support and respect law enforcement and the job they do.

Ironic note... my very first ticket was from GV CHP for driving without a license almost 40 years ago. Kids do stupid stuff, I was no exception.

I mean between illegal immigrants and black kids, look at where this nation is going to. The black kids were probably illegal immigrants as well. I just know in my local rural area of NC, good old white men who are blue blooded born US citizens don't drink and drive and kill people...had to mention "men" because of Miss Jamie Lee Komoroski in SC who made national news killing a woman on her wedding day driving drunk. What people forget is that woman is actually a Dang Yankee, as women raised in the southern Bible belt as good Christians would NEVER drink and drive...
