So, got hit out of the blue with something. Wife asked if her coworker/friend could stay in old house for a "bit", she would be willing to pay something, but she's having a "bad situation at home".

Now, wife was pretty upfront with this girl, only till we are ready sell, and we would be over there to work on house too. So, I can go ahead and make probably 3 separate arguments in multiple directions.
1) you (me) said you didn't want to be a landlord, what if she ends up staying longer, what about repairs, ect
2) somebody (me again) is paying a mortage, insurance, taxes, power bill; and all or a portion of that off somebody is good
3) well, you aren't a very good friend, you shouldn't charge a friend in need anything

So, I did ask two questions; we talking days or months; and is she into kinky 3 way stuff. That last one is just a joke

hmm... depending on the tenant, this could go many ways. I'd be inclined to help, and suspect it's better to have no written agreement, that can later be used for tenants rights. But I'd talk to some friends who are either landlords or lawyers, before deciding on how to proceed.

If moving forward, I'd be inclined to just let the person stay there free of charge, until I am ready or able to sell. As soon as you have a tenant's agreement and money changing hands, I suspect all the rules change.

We deal with renters as do others on this site.

You either go all the way, rules, lease etc and know the tenant rights in your state/city or you don't do anything and just treat it as family friend staying for a while.

But I will say, you need to set up some rules and timeframes no matter what.
Just need to decide rental or friend short stay.

How long do you think before ready to sell?

How stable is this person ?

as stable as any other ICU nurse.. so 50-50. But seriously, normal lady, with a decent full time, well paying job

If it's going to be more than a couple of weeks, do the paperwork. In most places, they'll treat it like a tenant situation with or without paperwork, but the paper protects you both.

"How long do you think before ready to sell?"

Our goal, which we knew was pretty aggressive was listed by end if October. That's probably not going to happen; just been busy with moving, doing stuff at new house, work, ect. Our real goal is closed on old house by is to have it sold hopefully by end of March.

Not knowing the particulars it’s easy to establish rights unless you are paying someone to house sit or similar.

Proceed with caution

That said I sold a home and the buyers had a moving truck on schedule…

The closing was delayed by the lender being late over a weekend…

I broke all the rules and let their long distance movers unload on a Saturday when closing did not happen Friday…

It closed Monday and all was good… I did not do a rental agreement…

The family was forever grateful and zero issues after sale as sometimes happens plus agent paid for home warranty which keeps me out of the mix

7 1/2 months and 3k in legal and sheriff fees plus lost rent with lots of damage and 5k hard expense to remove junk cars and trash…

and people in the know say how lucky I am
