Right on the money Bob, and not just ROPS but any factory installed safety device. OSHA has issued field directives that say, in a nutshell, if it came equipped with it you are expected to use it.

Oh and I agree about this being inane.

I don't think this thread lacks sense or substance at all. Lots of folks do not know what units the laws require ROPS on or when. It is a question that comes up from time to time and is worth discussing.

David, I understand your position, and I do agree that some substance and information was included in the body of the thread. But I was referring to the way the question was posed, as it was very ambiguous and left too much to be interpreted in too many ways.

Maybe I am crabby today, but if someone wants to ask a question, then ask it so people can answer it, not so that you have to explain it because it creates incomplete answers that may or may not be accurate depending on the situation. That can lead to dangerous conclusions by future readers of the thread.

Feel free to attempt to prove me wrong. Or try to buy a tractor, or try to import a new tractor without a ROPs. Its your choice to do any of that. I have imported equipment, I know what I was required to comply with. I encourage you to do the same.

But in any case, I am not required to satisfy your needs or desires. I am not required to answer to you. And I am not required to dig up laws and cite chapter and verse to you.

Dumdog, thanks for jumping in to help, but that is only part of the law as it pertains to tractors used for commerical use by an employee. There are additional regulations for new tractors being imported and/or tractors being sold.
