Bob B . . . I agree with you 100%. Just because you didn't know that you paid for stolen property does not mean that you are off the hook. Even if you are NOT charged with receiving stolen goods, you will lose the tractor and your purchase price. In theory you can then go after the guy who sold it to you, but odds are, he covered his tracks and you won't find him again.

You guys are missing my point entirely. Let's say I buy a brand new car and give it to my son for a buck. Is there a problem here? No regardless of the fact that I just sold, errr gave the car away for peanuts compared to what is was actually worth. Documentation is whats gonna save your fanny my friends.

I have never purchased anything stolen and I am not condoning that. I am merely making a point that price is not merely important as documentation and serial numbers.

How many of you turn away real bargains when you see them? I'll bet not many. Just make sure that any buy sell deal is on the up and up with the paperwork.

Paper work does not always make it on the up and up. I have been in this business long enough to know that paper work can be forged with todays computer programs its no problem at all. So you would have to question a low ball price on something that is worth more money unless you know the circumstances behind the low ball price. Like the example you gave, or one I run into sometimes divorce and the guy does not want the ex to have the satisfaction of taking his toy. OOPS! I mean working machine.

I agree there are always extenuating circumstances that will change the game. I do know the State at least may come asking questions about that $1 sale. /forums/images/graemlins/blush.gif (sales Tax) maybe some other agency also. I guess you better have a good answer. Any investigation is a risk of someone making the wrong finding

If you have a bill of sale, or can produce a copy of a cancelled check, showing that you paid for the tractor, that will keep you from being charged with receiving stolen property, you won't be able to keep the tractor but you also won't go to jail.

One thing is for certain. Buying used equipment, any used equipment including tools brings a certain amount if risk into the equation. If a thief takes a tool to a pawn shop and sells it, and you come along and buy it, are you responsible if it turns out to be stolen? If you have a receipt for your purchase then I would think not, but you will still loose it nonetheless.
