Renegotiate the deal. In the new sales contract you'll add a
clause which refunds a 1% discount for each day the dealer fails
to meet his agreed delivery commitment. When the
salesman/dealer balks and states they can't risk to lose money
with such an agreement, remind them your time is valuable
and you can't risk to lose money with their inability to fulfill
a sales agreement. Nothing personal, it's just business.

You may not get anywhere with this approach but I'd expect
you will have a delivery date which is believable.

Remember that anytime you do renegotiate it's a two way street. While you are released from your deal, so is the other party. The dealer may have had someone else in who'd like a tractor just like the one you ordered and who is willing to pay a premium to have it now. As soon as you offer the idea of renegotiation and the dealer accepts the entire original deal is null and void. He has no obligations to you on any part of the prior, now cancelled, deal including selling you the tractor at all.

Nothing makes me think the dealer would want to do such.
It simply illustrates the point of the buyer's time/schedule
being a valuable commodity. This 'dealer' obviously has
forgotten the importance of his customer.

Obviously.

If you feel the dealer is doing you a favor by taking your money,
so be it. Otherwise you have the option of renegotiating with
the current dealer or seeking one more accommodating.

Finally, it is the 'dealer' in the above scenario which needs to learn
of the 'two way street'.

Why are you mad? This is common to wait a while. I was told, not sure if it was true, probably not, that my dealer had to assemble my LS170? It sounds like you saved alot of money so be happy.

I, as KiotiJohn had said, had to wait for my BH (9 weeks). It can be very frustrating, but I/you really can't hold it against the dealer. I even got a call from the Vice President (James P?) of Kioti Tractor over this matter and was assured that it was on Kioti's end that the delays have occurred. My dealer was on top of the matter 100% and informed me weekly of the status.
Bottom line, can't blame the dealer. They want your business. G

Willy1947, you haven't responded at all to any of the posts. I'm wondering about how you're thinking on this matter now? I think you can understand that no dealer WANTS to have a problem like this, and that MFG companies are most often the cause. It happens with all the best. Let us know what's going on okay? John

Sorry for not replying to anyone. Been out in the woods all weekend. This is the first time I have been at the computer.

I have been dealing with the owner the entire time.

The tractor, L3830, was delivered promptly Saturday morning just as they said. I used it a decent amount over the weekend, but not as much as I should have. The Saturday delivery messed up my work schedule.

I'll first say, I was very impressed and pleased with the tractor. It preformed very well and seems to be completely defect free (knock on wood).

The guy who delivered it, didn't even think they had a loader there for it. But then again I shouldn't expect him to know those things. I just asked question to see if the dealers explanations matched what the shop employee was saying.

I guess the next test is how long will it take to get the rest of it assembled? They are supposed to call me this morning. I would assume they'll want their money soon /forums/images/graemlins/wink.gif One thing I will say is I have not signed any paper work and I have given them no money. The owner was very up front and said I owed him nothing because the tractor isn't finished. This was very nice.

All in all I am dissappointed due to delivery expectations, but I won't hold this against the dealer or Kubota in general. I know delays happen. I was just concerned because I didn't feel like they kept me in the loop on when things would be finished. At the same time, I've been under a lot of stress and that doesn't help either.

The quality of the tractor and the willingness of the dealer to bring it out, pick it back up, and then bring it back will make up for it in the end. Thanks for the replys. I'll post 1st delivery pictures soon and then 2nd delivery pictures.
