This article should have been titled "How to act like an irresponsible whining teenager that shows no gratitude for having been cut a break." By an irresponsible whining college student who cries when getting a ticket.

The article has advice that probably worked in the author's situation and has been grossly misapplied to the general case. This is why you hire a lawyer. They are trained in multiple techniques to get the charges reduced without pissing off the judge/cop. They should have a professional credibility that they bring to the case and as your advocate they will seem much less whiny even if they tell the judge the same thing you would.

PLEASE don't take this as a personal attack ladytonka. I just disagree with the advice.

I agree. Once again no offence. This advice from that (STUDENT) would probably just make things worse on you. I wouldn't go to all that trouble. I would just pay the fine and move on with my life. xd

In regards to the post by the member that stated a possible solution to having a speeding ticket dismissed by the initial LEO, I would like to add some actual facts pertinent to LAW procedures. Rest assured that it isn't my intention to ridicule the TBN member, but to add conflicting substance to the alleged author's - law student -comments in regards to the link provided. I just made a phone call to my youngest Brother, who graduated from the University of Tennessee Law School. He was a part time professor at ETSU for several years, in addition with his position as a member of a Law Firm. He is presently working for an agency that is involved with National Security. He advised me that there is actually a Felony charge on the "Books" in many States relating to "Attempting to influence a Public Servant". If LEO's would agree to meet with parties that wanted to discuss the dismissal of tickets, they would have little time left to actually enforce the Laws on the Books. In regards to making a call to the "Judge" or "Prosecuting Attorney", in order to discuss the case, your chances are better in winning the Lottery. Not only my thoughts, but FACTS. Thanks for listening. BTW, my Brother usually doesn't resort to name calling, but one of the words he used to describe the alleged law student, was a "CLOWN".

Here in Louisiana you go pay money to a lawyer and the ticket goes away. This is how the game works: lawyer "donates" a lot of money to the judge's campaign war chest. The happy judge then dismisses tickets for his favorite attorneys. So the judge makes money, the attorney makes money and your ticket goes bye-bye. It's a win-win situation. Lol

I figured you were in VA, as am I. My observations of traffic court in the Roanoke area are that with a good driving record, the judge will allow you to go to a one day traffic school so you won't lose your +5. On a good day the judge may drop the ticket entirely . Its a shame points peak at +5, I would be about +20.

It's simple, get an extension on a court date.Chances are the officer will be off on the new day set on the calender day or will not come in to defend ONE ticket.
I did it of my wife who hot an illegal turn ticket, the officer never showed u, case was dismissed.

Dear Sir: Your previous description of law proceedings pertinent and prevalent to speeding tickets is RIPE with the smell of Plagiarism and CORRUPTION. Just a thought? What prevents a LEO from issuing tickets without merit, when the JUDGE'S campaign coffers are running low? Rest assured that it isn't my intention to show you any Disrespect in any form or fashion. My statements are directed toward the so called COURT SYSTEM in your State. This behavior is antiquated and definitely not consistent with properly conducted legal proceedings. I disagree with this type of conduct and behavior, whether it be advocated or practiced by any of the Court systems. This includes, Local, State, or Federal levels.

Solid advice. At least in California where I reside and have some knowledge, paying an attorney to help with traffic court is a waste of money. If a commercial driver it may be worthwhile but for your average driver not at all. The standard of law practiced by the traffic law attorneys that I've observed is shameful.

I got a good giggle out of this one.... dam lawyers - ruining the world is a real common thought from the masses.... then as soon as something goes against a person first thing they do is shout out to a lawyer to get them off. even though in this case for example this gentleman admits he broke the law by a really good margin and already given somewhat of a break.

hard time figuring out people sometimes. Laws only apply to others (not me) is something I see and hear too often these days.

Depends on the jurisdiction, my son LOVED court days on his day off as he got guaranteed overtime pay no matter how long he actually had to be in court. Every Officer whether municipal, county or state that I ever requested to appear as a witness in connection with a warrant was happy to show up and was never in a hurry to leave, money in the bank.

Vermont now has implemented a fee for a continuance on civil traffic tickets. This has curbed the abuse of that privilege. The Vermont Traffic Bureau that manages all tickets written in the state- schedules ALL- or as many tickets for an officer on the same day in court. So, one person doesn't influence an officers attendance on that day but, the need to schedule another day and municipalities paying additional over time has led to this.

I just learned recently, from a newspaper article, that the little town I live in uses a part time judge who is not a lawyer, and a non-lawyer judge can only serve in a court that is not a court of record; i.e., no court reporter or recording of the proceedings is made. So people who understand the system simply appeal their conviction to the county court. That will do several things: (1) it sets another date, probably pretty far in the future, (2) the trial is conducted as if it were the first trial, so all witnesses have to testify again; there's no record for an appeal judge to base a decision on, (3) this little city has to pay its officers overtime to go to county court, and (4) if the defendant is found guilty and fined, the fine goes to the county instead of the city.

So now the city is considering making the municipal court a court of record. Instead of a court reporter, they can just tape record the hearings with equipment they already have, and if a defendant is found guilty and wishes to appeal to the county court, he/she will have to pay to have a transcript made. And of course the city will spend a little more on the salary of a lawyer to be a city judge.

I think Missouri has something similar and now all municipalities in my area are using lawyers as judges. We use to have a lot of non lawyer municipal judges, but they have all pretty much been replaced.

Hire a lawyer or pay up. I know here, a cop has to account for every ticket in his book. He cannot alter it or dismiss it once issued. The ticket gets recorded immediately these days, electronically.

I agree with 300UGUY. Once written it can't be taken back but here in NY you can call the Assistant District Atty. office in your county to request a recommendation for ticket charge reduction. Its usually a recorded message. You can plead your case to him in writing and basically beg for charge reduction recommendation. Usually have to write up some good reason why this happened. If the ADA sends you a recommendation for reduction you would have to fwd it to the court Judge for him to review. He can agree or disagree. The Judges here have the final say, they can reduce the charge and fine by requesting you attend the driver safety school, not reduce the charge, or dismiss the charge. A driver safety class for point reduction or as a requirement for a reduced charge can be boring / tiring (its a 6 hour class here). I had to take the class for an employer. His insurance company would give him a discount for having all his drivers take the course. My Employer paid for the course and it had another benefit. Upon completing the course I get a certificate of completion. The Employer got a copy for his insurance co. and I sent one to mine for a 3 year insurance discount.
Having a clean license without tickets or points and being a fine upstanding tax paying citizen might pull some weight but it may be tough since you already have some points. A lawyer may be the best way to go if you're unsure.

Let's not fool ourselves. This is Louisiana we are talking about. Proudly leading the way with among the highest rates of corruption throughout the legal system in the US, and sadly, top tier when it comes to illiteracy, poverty, childhood pregnancy, obesity or just about any other negative parameter there is.

Here's how it works in Shrewsbury, MO, one of many speed traps in St. Louis County:

1. The municipality has a couple blocks of 30mph on a busy road with mostly 35mph limits elsewhere.

2. Local cops stake out the slow stretch to catch someone going, say, 44mph, then write 40mph on the citation. Fine is $100 in municipal court. Be nice to the cop or he'll take your drivers license.

3. Dozens of storefront lawyers compete for the ticket-fixing business, so it costs "only" $40 to get the citation plead "down" to, say, littering, with a fine of $160.

Hence, for just double the money you can avoid a moving violation and subsequent insurance rate increase.

Everything about this process is dishonest and corrupt, but perfectly legal, and I believe it is widely available in the USA.
