Yep I believe you are right. In many states cattle have the right of way. I believe this is still true in Florida as well.

many people though look for someone in uniform if you mention a cattle guard to them /forums/images/graemlins/smile.gif

Yep.. florida is fairly friendly to tractors and hay wagons going down the road. The county I live in is specifically horse country. I see a tractor ona road at least 3 times a week.. not counting the county mowing tractors.. which simply start at one end of the county and mow across it.. no trailers or anything.

I've never had a police officer even blink or look twice at me running down the road on mine..

Things are a bit crazy Up here in NY.

You can get a DWI for driving anything even on your own property. Yes drive any thing on your property and never go on public roads.

You can not sleep in a motor vehicle on private property if you are drunk if the keys are in it. Someone I knew when I was a kid got a DWI In his driveway.

The first situation is hard to understand, but not the second.

Put yourself in the policeman's situation;

1. A car in a driveway.
2. The key is in the ignition.
3. A drunk in the driver's seat.

What conclusion would you come to?

Same thing for drunk with the keys in the ignition in KY. Of course the private property is usually a parking lot.

I agree with slowrev that private property most likely means at a privately owned business location like a parking lot.

I wouldn't think their conclusion would stand up in court while on your own property. They didn't catch the person "driving" while intoxicated. They caught him "sitting" while intoxicated. Heck, he could have had a fight with the Mrs. and came out to the car and was listening to the radio.

You know.. that's at least a plausible story.

For whatever reason.. you are setting inyour car/truck listening to the radio.. or whatever.. making a cell phone call.. etc.. and technically you could get a dwi.. I think in a few situations.. that it shouldn't be allowed. for instance .. what if your power was out and you were in the car.. to listen to the radio/make the cell call.. etc...

At some point.. being parked on your personal property should mean something... Given that logic.. you couldn't mow your lawn if you had a beer with lunch/dinner.. right?

The deal was They were at a party (all day) they were in the car listening to a high end car stereo. The cops came for a totally different reason, were unable to find any other violations, and made the arrest.

Bad luck.

If it were me Today (snow white record) on my property I'm sure my brother (lawyer) would get it thrown out.

But it still would be a pain and get your name in the paper.

Heres one for ya. In Lexington KY, you cannot park on your own lawn. A metro cop will come up in your yard and write you a ticket.
You must be parked on a paved drive or gravel. No parking on the grass even on your own "private" property.
