About once a year or so, I see someone who has taken their camper off the truck, but the extended hitch is still there, without a trailer.

Ok, I have to ask... How can it be illegal to drive with your tailgate down? How could you haul lumber, atv's, or anything else that might be longer than the bed length?

My question wasn't about your post. I think the flagging law is somewhat common, but is in reference to flagging the material carried if extending beyond 4 feet for example. What I have a hard time believing is how a state could make a law against driving with your tailgate down. My reply was to:Never said it was....my coworker said he received a warning citation for it though. Apparently there is a law concerning flagging anything that extends X? far behind the vehicle and that is the basis for many of these reported citations.
i didn't explain the tail gate deal, so i will now of course if you are hauling something that extend's over the tailgate no problem. i have not seen the law in writing but this is why i said that it was illegal. when i took my test for state inspection i did a hand's on with a tropper's car and a pickup truck, when i finished the tropper said well you did very good but you missed a couple thing's. the tailgate was down on the pickup and he said you didnot check to make sure the tailgate would latch, i said i didn't see anything in the manual about the tailgate he said it has got to latch or it got to be removed and if it's removed something has to cover the space such as a net, and he proceded to tell me it was illegal to drive a pickup on va highways with tailgate down if you were not haulinng something that required it to be down. so i assumed he knew what he was talking about. oh yeah the oter thing was i didn't check the tag light under the down tailgate.My question wasn't about your post.
