Remember the three S's. Shoot Shovel Shut up

I agree, though they are not protected in my state.

I have killed one too many a timber rattler on my property, which are plentiful and I will continue to do so every time I see one, or just about any snake for that matter.

Here are the results on timber rattlers being protected:

For me it is a delimma. ............

I gathered the OP was asking for ideas to avoid killing them, or asking is it justifiable? That's a reasonable and thoughtful question in my mind. I am sure if we had poisonous snakes and I saw one around the house, I would get rid of it. I would also think about how that may be avoidable in the future. The answer may be, it isn't avoidable, but it doesn't cost anything to think about it.
Dave.

Yep, pretty much hit my intent of the post Dave.

They are on the endangered list on my land

I say since the snake is on your property now, it is a risk to you, your family and pets. I would dispatch it to end the threat and then think of an alternative plan for the future if you locate another one.

I'm just glad I live in the only state with no posionous snakes, that said, I still would do the sss if I was in your shoes. Having kids and pets around it's best not to take unnecessary risks.

I have only seen one rattler here, and I was hiking on the AT when it rattled at me to let me know it was there. It was actually neat to watch it, since it wasn't coiled ready to strike.
