He did say he turned it in to his insurance and is waiting to see what happens with that. I don't think he is trying to evade responsibility.

Probably a case of innumeracy. The sign on the bridge says 3 ton limit. The driver probably had an idea of the weight of the tractor in pounds. Trouble came in converting pounds to tons, IMHO.

Correct me if I'm wrong, but if your driving you car, and you accidently destroy state property, can't they charge you the repair cost?

They can, and they do in this state...ask me how I know!

Don't know how many times I had a crane operator show up on the job site and ask me what size unit it is. Tell them 40 tons and you should see their eyes get real big LOL (only about 5,000 lbs). Needless to say weight is gone over prior to the crane showing up.

I'm betting if the insurer has to pay, they'll recover from the tractor owner.

As the insurer should, right? The contractual right of subrogation is a basic feature of casualty policies. The policy is to protect the insured, not the party that caused the harm (nor the wrongdoer's liability insurer).
