I don’t think I have ever started a post before. Feels weird to have to come up with a subject. I have been out of town on business dealing with the John Deere and New Holland lawsuits that are pending against a fair amount of part time Grey and Chinese tractor dealers across the country and haven’t had time to read the posts. By the way don’t paint your tractor green/yellow or blue because you are likely to be sued mightily for it. Anyway just wanted to let everybody know that I DO NOT answer any post EVER to create business for me or my business. I am here because I love tractors I learn a lot from all of you that makes me money so in return I try to pay back the favor you probably don’t even know you are giving me. Plus my life is based on the premise that I should give far more than I receive. If I added up every dime that I have made form sales in chat rooms it would buy me a super sized fry at McDonalds. Anybody who thinks you can sell tractors enough to keep the lights on in a message board needs to get back on the lithium. If I want to advertise I can find a local rag and run a $5 a week add and I am guaranteed a sale. I will continue to answer questions and enjoy your company unless I am told to leave. I thank Mohamed for the board and letting me be a part of it.

Can you comment more on this lawsuit thing? Are they trying to do what Kubota did and restrict Greys from coming into the country?

Hopefully the lawsuits only go after the guys who paint Yanmars green and yellow or adverstise them as "Factory Reconditioned". IMO, JD and NH have no business going after the honest guys like Buck who represent thier tractors for exactly what they are, used tractors imported from Japan. On the other hand, the folks who advertise a Yanmar as "factory reconditioned in Japan" ought to be sued out of existence, unless I am mistaken and Yanmar has all of a sudden started reconditioning tractors and sending them to the U.S.

The lawsuit is a frustrating deal. It affects us all on many levels. JD and NH and Kubota are all suing for "trade dress" infringement (I’m not a lawyer so I might get some of the nomenclature wrong, please forgive me). JD says that anybody painting any tractor or implement green and/or yellow in any combination is coping JD. New Holland is saying that their colors blue/black and white and any sloped hood with flared sides is there "trade dress" and no manufacture can have any of those features. Kubota is suing Kioti specifically and there is nothing new about that. The frustrating part is JD and NH are targeting Chinese tractors dealers and trying to get injunctions against any Chinese factory importing into the US. Almost every factory in China is named by either JD or NH. Most of these (not all) dealers are mom and pop outfits and cannot fight back. I agree that if you build something somebody should not be allowed to copy it note for note and sell it but I have a white Ford a white International a white Chrysler. Wouldn’t that also be a trade dress infringement under the same argument? . It has come to a point in this country that if you can’t match the person suing you dollar for dollar you loose. That is very un-American. There is no way that if you put a Jinma and a JD side by side that you couldn’t tell which one was Chinese. If they get an injunction against Chinese machinery then every individual that has bought a Chinese tractor just got screwed. No more support, no more parts and no more trained mechanics that have experience working on them. Should only the wealthiest people in this country be allowed to own a decent tractor? My customers (either grey or Chinese) are not JD,NH or Kubota's customers. 99.9% could never afford a big three machine. I had an old guy years ago write me a letter saying if he didn’t have his tractor to get around on, he would have had to move off the ranch where he lived his whole life. He was a poor guy and there was no way he could afford even the cheapest old beater JD. The great thing is that he had a choice. The big boys want that choice to disappear and have you finance for the next ten years to get the work done at your house. That has worked so well for farmers........ I love competition in a fair market. I almost live for it. Bring it on because if I want it more than the next guy in America I can win. Suing people to compete is a lazy mans game. If there is a dealer saying “this tractor is just a like JD or NH” then he is a crook and should be shut down. The rest of the honest dealers shouldn’t have to pay for the bad ones. None of the dealers in the suits were ever asked by JD or NH to paint their tractors a different color. Because it is not about color it is about competition.

This is just my perspective looking from the inside out. I think the big boys build great tractors and I wish I could afford one. I had a choice, a new tractor or college for my son. Since he is picking my nursing home I went with the obvious choice. Sorry this is so long.

Case and NH are part of the same company, <A target="_blank" HREF=http://www.cnh.com/about/about.asp>CNH</A> which is why they look similar and why they are not suing each other. They probably wont sue Steyr (a European brand) who is also part of CNH.

I guess the companies suing want to stop people saying "it is made by John Deere", the similar paint job implies the same thing. As long as it says yanmar and it is red (or at least not green and yellow), no one can imply that it is a Deere. I guess Handler's will need to change paint colors.

Now cars come in different colors (as opposed to tractors) so color is not an issue. However if Chrysler came out with a vehicle that looked just like a Ford model and said or implied it was the same, there would be lawsuits.

They will never manage to kill the import of the tractors because painting everyone with a broad brush is unconstitutional (assuming someone actually fights). CD burners exist and can copy music because copying music is not their only use.

This is one of the tractors in question. Not sure which model JD that looks like but let me know if you find it. Also if I bought a can of JD green spray paint and it came out the color on that tractor I would take it back to the store and ask for my money back.
