TYM 233 PTO doesnt work. Oil level very high

I bought a 2009 TYM 233 and the PTO in not working. When I bought it, the owner had a 5' brush hog on it to show me it worked and it did!. But now at home, it does not work. The button illuminates but the lever that you push to engage is like loose, just can move back and forth real easily like something is not connected inside.

I have also noticed that the fluid level is higher than when I bought it but I have not added any oil. The loader is fine and the hydrostat trans works good as does the 4wd.

Any ideas??

Check the remote lever under the seat and make sure it in the middle not to the left or right.
