Beenthere, if the salesman lied and can't get the parts he promised he should answer the phone, apologize for telling a lie, call Woods to get the current information and return my call. That's all I'm asking for. I realize he can't make the part himself. I also know it's not his problem that I lost vacation time and took days off, but none of that would have been an issue if he would have been honest and followed up on this matter. Apparently he only cares about making the original sale and does not care about a future customer.

Nothing like familiarizing yourself with relevant provisions of the Uniformed Commercial Code; in your case pay attention to Chapter 382A, Article 2, Part 3, General obligations and construction of contract, Section 382A:2-315 “ Where the seller at the time of contracting has reason to know any particular purpose for which the goods are required and that the buyer is relying on the seller's skill or judgment to select or furnish suitable goods, there is unless excluded or modified under the next section an implied warranty that the goods shall be fit for such purpose"

Of course, your contract probably has language that states no implied warranties exist. But if you told them you absolutely needed a backhoe up front and they suggested the 2305……this certainly gives you something to discuss with the owner. Do a Google search on “Warranty fitness purpose” and see if it applies to your situation. Good luck, you need some.

My suggestion would be to put in writing what are the concerns, just be specific about the issues. 1......X and mail/fax it along with a cc: to Deere directly and request a meeting to address each question. I would at this point begin a documentation process and ask that both sides sit down and directly address the point to point issues.

Decide if your goal is to

A: get the backhoe resolved on this machine, or
B: to return the equipment and get a refund.

If you want it fixed, you need to keep the pressure up on Woods to deliver the brackets. I would recommend calling Woods directly and asking for the name of the account manager that handles that dealership and work directly with that person.


If you decide you want a refund right now or at some future point:

1. Write a letter demanding a full refund, explaining that the equipment is worthless for your purposes and _briefly_ describe how the dealership misled you on the compatibility of the equipment combination. Give a specific deadline date for them to refund your money and accept return of the equipment. The deadline can be as short as 5 or 10 days. Be sure and mention the exact amount of the refund that you expect and that it is for the entire purchase - tractor and backhoe. Send the letter to the attention of the owners of the dealership, registered mail. Don't waffle about what you want and say you want a refund OR it fixed. You have given up on them fixing it and cannot wait any longer and the only acceptable resolution at this point is a full refund.

2. The day after the deadline, if you still don't have your money back, file a complaint in small claims court. Or hire a lawyer and file a claim in regular court. Either way, eventually the court process will resolve the issue in some manner. "Eventually" is a key word here - it could be up to a year or so. The sooner you file your claim, the sooner the clock starts ticking.

You'd need to go to regular district court (not small claims) as states have dollar limits. In MN it's $5K, in OH I believe it's $3K.

Plus, winning a judgement in small claims court does not ensure collection of said judgement - that's up the the prevailing party. It can, and does, get time consuming and messy. More court paperwork, writs to be granted by the court, etc.

So - if you're going to court you'd need a lawyer and you'd most likely be responsible for their fees as well.

Why don't you go to the dealership or contact the regional representative and have them meet you at the dealership?

It does sound like Woods is the party that is the bottleneck but it would be nice if the salesperson would be doing the legwork with Woods after their mistake about the mounting on the 2305.

So what was Woods latest story? How do you know they aren't covering up for their inability to deliver the brackets? I think they are the bulk of the problem. Anyway, when Woods has the correct plates available, I can't imagine them taking more than a few days to be delivered anywhere stateside.

I'm sure glad my dealer takes care of me as if I were their own child.

He deserves a call, but ASK FOR HIS ADMINISTRATIVE ASSISTANT. If you talk a good line, that person will make your problem go away.

I called the owner this morning. I was told by the receptionist he would be available at 9:00. I was told he was in a meeting. Arin called me around 10:30. He said he just checked on the brackets and Woods has them on an "engineering hold" until December 16th. He asked me what I wanted to do, either refund the backhoe or wait. I told him what I expect at this point is a phone call on the 16th to tell me the status of the brackets. I will not wait for the call any later then the 17th. I proceeded to tell him how I will not tolerate no returned calls and being left in the dark. He said, :I just called you back" I said, after I called your boss. He said he didn't know anything about that. ( the owner never called me either) The message I left was for him to call me. I didn't say anything else. Apparently he's not going to return my call either. I have been nothing but respectful on the phone to everyone at J.D. Equipment.

I have been self employed for nearly 25 years. I would not treat my worst customer like this. I realize that any issue a customer has is important to them and treat them accordingly. Unfortunately J.D.'s way seems to be the new way of doing business. I definitely think it's the way to be profitable. Only be concerned about sales. There are enough people to buy, they may not need loyal customers. I know after being around our family business my entire life that there is not much money in service, it's all made from sales. (we have only ever serviced and rented RV's, never sold them)

I wonder if there is a problem with the new attachment brackets from Woods. There has to be some reason they are not yet available. I emailed Woods again to check on them, but have not heard back yet.

Sounds like you have good reason to be 'upset', and I hope in a week or less you get some satisfaction.

What is going on may just be the tip of an iceberg of problems. Sounds like Woods is having a problem, and that might be one of making the brackets for the Deere, that they are liable for any damage done to the Deere tractor. Maybe they are finding that their bracket doesn't protect the tractor housing enough to handle their backhoe. There is, IMO, a point at which putting on a piece of heavy equipment with lots of power, will over stress the tractor. This size tractor isn't very big and I wouldn't even think of putting a hoe on it, but I know there seems to be a desire to put hoe's on as small a unit as possible - and maybe this one is 'too' small for the size hoe of interest. Asking them to do something that they may know is wrong (I'd hope they would admit it if that is the case, and back off so you can take a different course of action) might be the reason they are in a quandry and not delivering. Must go beyond making some simple brackets so it will fit. Very interesting problem, and sorry anyone is left out this way.
I can't see where it's a Deere problem, other than the Deere dealer who owns his own business. If Deere was making the brackets, then yes, a Deere problem. Just my viewpoint, which doesn't always 'see' things clearly. /forums/images/graemlins/wink.gif

I totally agree. I don't think it's a Deere problem. I never thought the brackets would be a problem even after I knew they had to be engineered. When I purchased the tractor I was told it worked fine. I now know the salesman didn't know the 2305 was different than a 2210. I don't see why there would be a problem with weakness if they work ok on the 2210. Also after looking over Kubota's BX23 and Woods BH6000 on the 2230 I think the Deere is at least as heavy duty. I'm just assuming there may be a fit issue or some paper problem. There's a lot more to the brackets reaching a dealer than just putting them in a box and shipping.
