.... and Kinze has way deeper pockets than you do. Think I'd just man up and have a rust bucket. No attorney in the right mind would take on that potential suit. Would have to be pro'bono and it won't happen.

That loader is far from a rust bucket. Every picture I saw just needs a little wire brush work, rust reformer and a little touch up paint. It is still worth a lot of money. My x300 JD loader has the same type of blemishes and is 10 years old now and blemishes aren't spreading. That reminds me to get to sanding them down.

The Kubotas can get somewhat close to Mary Kay pink....I have one, that piece by piece I am bringing back to orange!

So you are saying that the warranty should be at the discretion of the manufacturer and they count on the cost to the purchaser being a deterrent? I own a manufacturing business myself and offer a warranty on our products (many of which are painted) and 1), the potential warranty claims are baked into the pricing of our product, and 2) I would never risk the reputation of my company over such a small (in this case to JD) issue. That they would speaks volumes about their business practices, and they deserve any bad publicity they get out of it. Perhaps if more people were willing to hold their feet to the fire they'd be more responsive. Apparently some of us have to pull the wagon so folks like you can get a free ride. You can thank me (and others like me) anytime.

No, my comment has to do with the legal system. I was trying to point out that even if you win a judgement, you still haven't received any fix to the problem you went to court for.

+1. I have a Mary Kay M9000 cab unit. It's a pretty shade of pink and it stays inside too. My M9000 open station stayed orange for some reason.

I have a couple JD's too and they are lima bean green so I guess it's not just Kubota and Kioti.

Least the paint on the JD's isn't flaking off...:D

If he'd a bought a 'Bota, he could be facing a total disassemble/come-a-part and put back together to fix a loose bolt inside the trans.

Only certain models and not a lot, maybe 500 nationwide. Not total disassembly either. Split and tighten the bolt in the HST. I heard about 17 hours total and it's 100% covered by Kubota. Every builder makes mistakes. Least they maned up to it without legal BS.

So you've won the judgement, now what. You still don't have any reimbursement of your expenses. Now you have to go to court again, at what point does the cost of attorneys exceed the cost of the repair? And attorney costs are not always paid by the losing party.

Even in Texas it is much easier than you describe. I got a default judgement against a large insurance company once and filed a lien on their main office in Dallas. They paid. My wife got a default against an adjoining property owner when he failed to respond to her lawsuit when a dead tree on his property damaged her fence. She had noticed him over a year before the damage that the tree was dead. She also advised his insurance agent that she had filed suit after several requests for payment. Their silence was gold for her. She perfected the judgement and filed her lien. She collected when he sold some property. Collected interest that had accrued for almost 10 years. Also collected a money judgement rendered after trial against some tenants. They ignored it for over ten years and the judgement was renewed so the paid some substantial interest. That is not all but it is enough examples to make my point.

I have also helped attorneys defend small claim court cases so a default is absolutely not a given in most cases. People can and do collect on small claim court judgements in Texas.But, when the defense shows up they are prepared.

He should get his paint fixed and he should go through the proper notices beforehand, during and after to be reimbursed. If not successful he should prepare a small claims suit. It’s not always easy as just stating that he wants money. File the suit. They may offer to pay at least something at that point.

If not, go to trial. He will probably lose if they present a defense but he might win. Then he can come back and tell us how he did it.

Don’t get the red azzz just because you wound up with a Kubota knock off. Every manufacturer winds up with some goof ups. And there are always two sides to every story.

He has a problem and a process for it to be remedied. It could go either way. But your comment doesn’t help and just seems petty.
