Shooting a bird in a tree off the ground, with a rifle, is not for everyone. It's too easy to make a mistake. It's relatively dangerous depending on how much property is between you and your neighbors and the angle at which you are to your target.
I would suggest that if are going to use a rifle, you carefully consider the location of your target and it's proximity to anyone or anything that could conceivably be in the path of the bullet before and after it ricochets.
You don't have to hit your neighbor, you just need to leave a hole where he can find it, and your in big trouble depending on where you live
Much better to use a shotgun or shoot the bird on the ground only.

Great point, something which many don't consider. I've been know to shoot squirrels with a .22 out of my back door; next road is 1/2 mile away. Even if I were to miss, (Yeah, RIGHT! ;)) the tree canopy would cause the bullet to tumble. Still I always make sure that I have a backstop.

When I was in graduate school in Lexington, KY, each fall the crows would nest in the trees by the graduate school (thousands of them), you needed an umbrella to walk to school (and it wasn't for the rain). The city would spray them (on cold days/nights) with a soap solution (it would remove all their oil) and they would freeze overnight, they would then collect them in the am by the thousands. What a mess.
