I'm glad that finally passed. Makes self defense a little less scary.

The castle doctrine was a good start.. but left so many grey areas. This pretty much spells it out. Same basic common sense rules apply.. you must fear for your ( or someone else's ) safety, and then at that point.. criminal beware.

You are never exempt from liability.

Do a quick search on NC liability law. The titles say LIMIT, not EXEMPT. The law limits your liablity as a landowner however it leaves in "implied permission". So if the tresspasser has tresspassed there before, or his buddy tresspassers have tresspassed there before, he can claim implied permission.

Just because it is law, doesnt mean you cant be sued.

If you found out this much, you can still charge them with tresspassing and have the culprit pay for the damage.
Just getting the charges filed might protect you from a lawsuit. At least, if this foolishness should end up in court, you have some standing if you file charges.

Wow, the fact that he was impaired probably saved his life as he was so relaxed he probably was out when he hit it and got seperated from his ATV (I am guessing here that is what is was, i have not read all the posts). Even if he did live.. that time.. I'd say he is still a "Darwin Award Candidate" in training. If he doesn't win this year.. I'm guessing it will just be a matter of time until he does 'win'.
