I think you're getting a little carried away. DOT generally regulates shipping of gas for commerce. Around here there are hundreds of people that use fuel caddy type gas containers that hold a lot more than 8 gallons of gas. When I kept my boat docked I had a 28 gallon one made by a company called Todd that said it met all the requirements for DOT, it didn't have placards nor did any pickup I've ever seen transporting them. There could be state and local laws you must meet.

which is to say over 8 gal has to be labled properly but nothing addtional.

it is not untill 119 gal! that a CDL is required and must be hazmat placard.

Can you cite a source other than this one?

I think the wording is misleading in that link. I was hesitant to use it but it is hard to find info that spells it out point blank.

It is my understanding you need a Hazmat for anything that needs to be placarded. Gasoline needs to be at 8 gallons.

Anybody carrying hazmat in an amount requiring placards in considered to be "in commerce".

Just carrying gas does not equate needed to be HAZMAT certified. Thinking so is insane.

Do you know that the DOT requirements are anyone transporting less than 440lbs of hazardous materials and gas in containers of less than 8 gallons to have OSHA Hazard communication training and DOT materials of trade training as well as having a fire extinguisher? Or that if you have gas in a container between 8 gallons to 119 gallons only the level of DOT training goes up, no CDL? Or that shipping documents are required?

A few months ago I just went through HAZWOPR training again. Since HAZMAT and HAZWOPR overlap there's quite a bit of HAZMAT information. Everything above is in the book. A HAZMAT employee is someone who works for a HAZMAT employer.

A HAZMAT employer is a person (i) who
(I) employs or uses at least 1 hazmat employee on a full time, part time, or temporary basis; or
(II) is self-employed (including an owner-operator of a motor vehicle, vessel, or aircraft) transporting hazardous material in commerce; and
(ii) who
(I) transports hazardous material in commerce;
(II) causes hazardous material to be transported in commerce; or
(III) designs, manufactures, fabricates, inspects, marks, maintains, reconditions, repairs, or tests a package, container, or packaging component that is represented, marked, certified, or sold as qualified for use in transporting hazardous material in commerce; and
(B) includes a department, agency, or instrumentality of the United States Government, or an authority of a State, political subdivision of a State, or Indian tribe, carrying out an activity described in clause (ii).

As i just finished my recert for the required Hazmat awareness training for the FD last month.

The reason i asked you to cite a source is because what you had listed did not jive with what was taught in the class for what classifies as Hazmat.

As for your understanding that anything that needs to be placarded is considered Hazmat is incorrect. A placard is simply a way to let people who need to know (aka first responders, FD etc) what you have in the container/truck/building. A placard does not indicate what quanity there is of the placard item. You could have 0 gal in that tanker truck or it could be full. The point of the placard is to simply provide information on the type of material. (although typically no placards are required until you reach the hazmat threshold, but theres is no rule that says if you have placards you are hazmat)

As for the broadest definition of what constitutes Hazmat, is hazardous materials in quantity greater than 500lbs. (though there are some obvious exceptions such as radioactive material which is always considered hazmat no matter what the amount)

Hazardous materials constitute 9 different classes. (in this exact order) note the number on the placard is the class of hazardous material.
1) Explosives
2) gases
3) flammable/combustible liquids
4) flammable solid
5) oxidizer
6) poisons
7) radioactive
8) corrosive
9) misc

I'm not sure where I got this link from but it''s for federal forestry workers. It's suppose to mirror DOT regulations, I think by law they have to. Over 119 gallons or over 1000 lbs of hazardous material needs a placard.

I see on almost all truck mounted fuel transfer tanks exclusions for use with gasoline. Does anyone know specifically why that is so, or is this lawyer speak?

I'm speculating but they have to be vented and thus per EPA, they need a charcoal canister to trap the vent vapors just like the system on your car. On your car, the vapors get sucked into the engine at start up. Not so with a transfer tank.
