I would agree with Joe. Don't bring in a lawyer at this point. My friend was able to get all his windows replaced to his satisfaction in his brick house without any lawyers. His window rep worked with him to get the situation fixed.Keep in contact with the manufacturer and make sure they make everything right: Windows, siding, walls, carpet, anything that may have been damaged in the failure or process of fixing said failure. Use the legal system only as a last resort. Remember, they have more lawyers than you.

While it would not hurt to privately get some legal advise, by all means I would not mention the word "lawyer" to your contractor, window manufacturer, or anyone else involved. As soon as you mention that you have spoken to or intend to speak to a lawyer, you will loose any hope of getting the contractors and manufacturers involved to take your side and work with you. They will then try to protect their own interests and you will have nothing but a fight. If you can't get satisfaction otherwise, a lawyer might be necessary, but that should be your last desparation choice.
