Keep in contact with the manufacturer and make sure they make everything right: Windows, siding, walls, carpet, anything that may have been damaged in the failure or process of fixing said failure. Use the legal system only as a last resort. Remember, they have more lawyers than you.

I would agree with Joe. Don't bring in a lawyer at this point. My friend was able to get all his windows replaced to his satisfaction in his brick house without any lawyers. His window rep worked with him to get the situation fixed.

While it would not hurt to privately get some legal advise, by all means I would not mention the word "lawyer" to your contractor, window manufacturer, or anyone else involved. As soon as you mention that you have spoken to or intend to speak to a lawyer, you will loose any hope of getting the contractors and manufacturers involved to take your side and work with you. They will then try to protect their own interests and you will have nothing but a fight. If you can't get satisfaction otherwise, a lawyer might be necessary, but that should be your last desparation choice.

As much as I hate to say it, I think you need legal advice now, not as a last desperate attempt.

When we built our house in OR, we ended up having problems with a large deck.

We contacted the installer and he strung us along, with excuses and attempts to fix it, which we now know were band-aids on the the real problem, which was faulty installation to the point it needs to be completely replaced.

What we now know, which he knew all along, is that in OR, after two years his responsibility to fix the deck is over, and we would be on our own. Very fortunately, we got a lawyer before the two years was up, but if I had not, we would be out the complete cost of the deck.

So, advice is to see exactly how long you have to file legal action, and only wait until you are about to run out of time before filing in court. You have no obligation to tell the manufacturer that you are contemplating court, and I wouldn't until the action was filed.

Ask yourself the question: "should I let the manufacturer tell me how he is going to solve the problem, or should I get a judge to tell him how he is going to solve this?'
