In all seriousness I think there are times in a person's life when you need a good attorney, in this case on who has expertise in property matters.
To me, the first (free) step would be to go to the county courthouse to get a copy of your property deed, the one you pay taxes on, so you know exactly and indisputably where your property is. It may require a surveyor also.
Most lawyers I've used over the years usually within a few minutes can give you an idea of his/her fee and required steps.
To me in the long run it's money well spent, a resolution. The lawyer should then via legal process be able to put an end to disputes, trespassing or other violations to your property.
Apparently you missed my post since no reply. I have to assume sometimes people enjoy the game rather than a solution.
My brother used to call me at all hours about...you name it...work, health, wife, kids,etc. problems.
I spoke years ago to his ex wife about it. She patiently listened, then a pause, and she said three words...and ONLY 3 words. "Ohhh the drama!"
So next time he called me about this or that I simply said "yes, and you love it".
Then I heard crickets chirping.
He doesn't call me anymore, not about dramatic goings on in his life at least.

charging him to use your property would be a bad idea, since he would have the paper to prove he's allowed to use your property!..

Actually, having him pay to use the property in well defined and limited ways has some advantages as it stops the time running for prescriptive easements - assuming that that time has not already run. And even then it could be helpful to prevent such a claim if appropriately handled in the agreement.

I致e seen it before where the police don稚 want to get involved in this kind of thing. They do not usually understand the issue.

At this point I would recommend putting up a fence after the survey. Then contact an attorney if the fence doesn稚 work.

A drainage ditch? Do you need one there? If not I wouldn稚 go that route.

OP - Have you fully determined the politics yet?
I come from rural Vermont and am moving to rural Mississippi. Small town politics are often run by heavy handed brutes who KNOW they are right even when they tell you the sun rises in the west. I wouldn't be surprised if he has friends in the local law enforcement that don't want to hassle him.

Usually they stop before it gets to bodily harm but often they seem to figure if they got away with doing something before they should get away with it now.
Since he is on the local town board as well as the farmers co-op board of directors he KNOWS he is more important than you so your minor fussing can be disregarded.

The place I bought in Mississippi was owned by a formerly well respected member of the school board. It is in a dry county. NO LIQU0R/BEER/WINE ALLOWED in the county. Locals tell of booze parties he used to throw and how the local sheriff used to guide traffic. We had a water board that was routinely overcharging people and all the testing of the water was done by one guy and he faked the tests.

I think you should be prepared to find another surveyor from a different area and get it done, it could be that your surveyor will find another excuse.

And don't build a ditch, build a moat. Down in Mississippi we could stock it with gators :)

A few years ago we purchased a 7 acre lot to build a house on. ..in my neck of the woods most house lots are between 1/4 and 3 acres.. so a larger lot is very rare. What you find out is that all the abutters of that larger lot.. seem to think that they are all entitled to use it how ever they see fit. We had to get it surveyed and marked, then have the local sheriffs dept send notice to the invading neighbors to remove their belongings from our property. One of them had a paved section with a basketball hoop installed on it.. he was not happy about taking it down... but having clear and unquestioned property lines is absolutely critical when it comes time to sell a property on. Nothing can ice a sale like property line disputes.

You did the right thing, what's yours is is yours. PERIOD

I'm of the opinion that the op should have tackled this sooner. That being said would I have handled this differently? Probably not as I'm also not a very aggressive person. That is until you really make me mad....

I'm also thinking that the neighbour is the type of person that is used to getting his own way and he really doesn't care who he walks over. I think that most people in the local area are wary of him because he can and will do damage to them. He's probably not agreeable to people telling him what he can and cannot do. These statements would include the local sheriff.

Make sure that you are totally within the law in what ever you do. Also when it comes to enforcement always go with the highest law enforcement that you can. I doubt if the local sheriff will be able to handle this as he comes up for elections too.

Expect repercussions as these kind are so used to getting their own way that you will end up paying in one way or another. That's probably what's making you so cautious. Also set up trail cameras or make a video when he is on your land.
