Matt,

Seems that you should be able to dispute this charge. With all the safety lights, etc., I cannot imagine that a judge would see fit to uphold this citation. I have sold my trailer to a friend recently and am "sans trailer" currently until I find another. I drove my tractor to a friend's house Saturday PM ELEVEN MILES one way to help him, traveling on public roads. We finished after dark and I drove back. I had a sherriff pull up beside me and ask if he could help escort me to my road which is less busy, to which I politely declined. He waved and said "bundle up" and off he went. Maybe you need to move to NC.

What were you charged with? On the ticket the trooper should have referenced your state's criminal code. Get on the internet and do a search for your states criminal code and see if that violation compares to wat you were doing. You said you had some jobs lined up to do with your tractor. If you can afford a tractor like that and all of the add ons, surely you can afford $1000 more for a trailer to carry it to the job site.

I was charge with driving a non legal on road vehicale. The thing is I went through the woods to get to my small job down the road and he gave me the fine because my tractors front end was on the road which is on a side street and I was between to park cars that the guy I was working for was his cars. If it helps i was pulling up side walk for the man and the troop just went by at the right time to see part of my tractor on the road. It took about a 25 mins for the local wreck to tow the tractor on to his flat bed including braking a snatch block trying to pull it on his truck. The next day i had to risk getting stop again for trying get it home witch was scary.And it does not play to buy a traler to haul my tractor if i am in town and ownly a few blocks away it pointless.

Mathew, That is crazy madness. I don't know any Wisconsin laws, but surely you can beat this in court. How does this city work on their own streets? I had a tractor job in a nearby city, and had to drive my tractor 4 miles in traffic (my wife followed) from the guys house to his place of business, with no problems. JC

Hi Mathew:
I can't help but think that you aren't telling the whole story. By your story the only thing that I can see that you might of done wrong is that you were blocking the road with your tractor, possibly without the proper warning signs. It seems completely unreasonable that the trooper had your tractor towed. Do you have a history with this Trooper? Have you had your drivers license suspended? (I don't think that You need a drivers license to drive a tractor) Sometimes a cop will give you a ticket that you don't deserve when he feels that you have done something else wrong that they can't prove (This is not legal or fair but it happens).
If you haven't already paid the ticket I suggest that you take your case before the district attorney. Maybe you can get the ticket dismissed. I don't know if you can get the towing and impound fee back.
Good Luck, Marshall

mars1952 makes a good point. If you can't speak with the DA's office prior to the court date, at least go to court over this. When you pay a ticket here in Alabama it isn't the fine that costs so much, it is usually the court costs. If your ticket is going to cost $150, usually $120 of it is the court costs. By going to court, it costs you nothing extra.

I am not a lawyer and these opinions are just from my experience.

Here are some possible scenarios for you;

The trooper charged you under one criminal code but what you were actually doing is not an infraction of that code. Cost to you zero dollars.

The trooper does not up. You move for a dismissal for lack of evidence. Cost to you zero dollars. (I have had this happen and is why you should always go to court)

The judge agrees with the troopers assessment of the infraction. You pay the ticket.

In regards to your road problem I would talk to a lawyer about it. I can see being given a ticket if your loader bucket stuck out into the road past the other cars with out having any cones around it or if you caused an accident but in NY it is only illegal to drive a tractor down the road if you are on an expressway. I drive all of my tractors down State Route 20 on a regular basis. If I am narrow enough I stay on the right of the while line. If I am too wide for the shoulder I must stay in the lane. If I am riding on the line then I would be at fault if there is an accident but if I am in my lane, with my SMV and flashers then I am in the right. I have State Troopers, town cops and county Sheriffs pass me all the time and never have had a problem.

A state trooper did pull my friend over for riding my ATV on the road. He was coming past just as my friend pulled onto the shoulder of the road to come around a tree and into the driveway. Since it was a farm ATV and was still on our farm and not out joy riding he couldn't write a ticket. He huffed and puffed but left with all the tickets he arrived with.

I do agree with the others though, if you managed to find trouble using a tractor on the road then you will easily find trouble if you bring a XUV down the road.

I will not be running the gator down the road it will be used for my property only and I am going to use it for snow plowing and around the yard usage only.
