I disagree.. the insurance companies have learned to settle their risks low, if possible, to avoid litigation witht he blood suckers.. that's my gut feeling anyway..

Soundguy I agree they have settled low because they just worry about the bottom line. If they wanted to put a stop to that then they would just go ahead and go to court. Most juries wont award money in the kind of situation you are talking about. Like bloodsucking general contractors there are bloodsucking lawyers that will take any advantage to making money. I find walmarts stance refreshing in some ways. They litigate all claims no matter what. It stops the people without ethics from trying to take money they dont deserve. Someone that has a legitimate lawsuit can win in court.

Legitamate.. like the woman who sued MD's and won a huge amount, even still huge when cut in half... all because she doesn't understand what 'hot' in 'hot coffee' meant?

Legitmacy and judicial process have so very little in common that many people use the court system as an income source.. the courts and lawyers allow this.. so even though a few companies stand on principle and litigate no matter what.. the trend won't stop till some judicial reform occurs i'm afraid..

You should get hold on the facts of the MacDonald's hot coffee. It was quite a bit hotter than norm due to a company and money saving policy.:D:D:D

Actually.. I can think of a legitimate purpose for extra hot coffee at a drive thru.. IE.. making it extra hot so that wheny uo get home.. it's still hot enough to drink.

wedging it down between her legs was a bad move on the womans part...

I don't hold roman candles or street flares between my legs.... or butane lighters.. or o/a torches.. why? because they are all hot and I don't want to get burned. They do however work quite nicely in my hands though...

Go read up on McD's coffee. I was burned by their coffee at about the time the woman had her accident. McDs had numerous complaints about the temperature of the coffee which was so hot it was causing burns. They had lawsuits on this as well. I was burned because I sipped the coffee. I had to go ask for ice to cool the coffee down. Some people say they like hot coffee. Fine. But you could not drink this coffee because it was too hot. It caused burns.

I could spill the coffee right out of my coffee maker and its not going to cause THIRD degree burns. The lady had third degree burns to her inner thighs, fanny, and genital areas. She was in the hospital for EIGHT days. Which is what happened to the lady. Yes, putting the coffee between her legs not a great idea but if the coffee had not been near boiling hot the worse that would have happened to her was a mess.

Why was McDs selling hot coffee that they knew it was burning customers? So they would not have to give a free refill. McDs could say they would give free refills but by keeping the coffee so hot they knew they would not get many request and thus save on their expenses.

The McD's case is a GOOD example of where our legal system somewhat works. Since McDs had been sued prior to this lady's case one can argue the system failed the other people who were burned and sued. McDs continued to sell coffee at temperatures that they KNEW caused burns. Coffee temps at other places was served at much lower levels.

There are far better cases of a misuse of lawsuits. This was a legitimate lawsuit.

The McDonalds lawsuit stands out as an American icon of frivolous lawsuits that defines our character as a wussified, litigious and responsibility dodging nation of pansies.

What's the hottest substance on earth? My mom's chicken pot pie! Its a joke, of course, that I heard on TV. Point is that hot food is HOT! The stove is hot too. So is fire. All this bull about McDonald's coffee being TOO HOT is just pure unadulterated garbage. I watched my grandmother drink literally boiling hot coffee all her 97 years. People drink hot coffee. People want hot coffee. McDonlad's coffee being 10, 20 or 30 degrees hotter than anyone else's has nothing to do with anything except how easy it is for a lawyer to manipulate 12 hand selected morons with 'facts'.

It seems there were a lot of customer complaints on the Hot issue. What temperature does MD's serve coffee at now does anyone know?:)

I don't drink coffee, but we do have a coffee maker in the office. Next to the hotplate there is a decal on it that says "HOT". Go figure.

And customers complain about everything. I know people who have gone through a drive through, gotten their coffee, found it not to be hot enough for their taste, and getting out of the car to go inside to complain about it. Hot coffee can cool down (duh, right?), but you can't warm up a cold cup of it in your car (duh, again, right?). Thus, when you order hot coffee they give you hot coffee. If you don't want it to burn your nether regions, don't dump it there.

I hit my thumb with a hammer the other day. It hurt. Why did the hammer company make the hammer so hard? If it was soft it would not have hurt me. I think I have a case. Maybe I'll retire early and buy lottery tickets and complain about rich people.
