It's not illegal to use dyed fuel on the road. It's illegal not to pay the taxes. As long as you track your usage and pay the taxes it's no problem.

I would agree with that statement and VA has a 'tax and tank fee report' that is used for such purposes.. The hardest part would be proving that the dyed fuel in your tank was the fuel you reported and paid tax on.. Does anyone know how would you pay the Federal tax?

IF you had your own bulk fuel it would be much easier to reconcile and prove since you could track total purchases and disbursements (taxable and non-taxable) vs inventories.. IF you were buying 5 gal here or there, it would be much hard to prove where it went and total gallons of fuel purchased.

Im sure Mr LEO would still write you a ticket no matter what proof you showed him on the side of the road that taxes were paid .. I have never heard of anyone getting a ticket and then proving that they had actually paid the taxes, and im sure a judge would end up hearing that case.

Some places I have noticed the cost of off-road fuel + taxes = more than on-road fuel though.. Still not worth it for me due to the hassle and potential problems - but to each their own..

Every January in NE Indiana they have a farily large Farm Show for several days at one of the Expo Centers. It is pretty much a given that if you pull in the parking lot with a Diesel Truck you will be checked for dye..

*I don't think they should be permitted to do that. On public roads yes but on private property that's going to far.
Also it singles out a certain group or class and implies since a person is a member of such they must be a candidate for tax evasion.

Around here they wont check on private land - but will set up a check point on a public road ton the way to/from the activity.. They also like horse/cattle/livestock shows, livestock markets, etc..

A lot of farmers (at least in VA) think they are exempt from road tax since since they are farmers (agriculture exemption), but they are not if it is used on the highway. Also the above activities usually involve diesel trucks pretty heavily..

I guess I'm wondering why these events are singled out when there are other events where there are large collections of diesel vehicles also.

Singling out farm shows and auctions implies they see farmers as a group are more apt to be tax evaders.
Either that or they see the farm shows as easy money.

All this takes is some logical thinking.

What other events bring together;

1. Large collection of diesel vehicle.
2. Lots of people who use large amounts of off road diesel.

Equals an environment with the Means, Motive and Opportunity to use off-road fuel in on-road vehicles. It's no more complicated than that.
