Never get away with it down here. Tanks have to be double wall and top feed if over 250 gallons and stationary. Fuel can't be delivered unless you have a permit for over 250 size. Under 250 the tank has to be mobile and/or double walled.
When I read comments like this it just makes me glad I don't live under such dictator ship laws/rules.

It's funny how some places outlaw things like overhead tanks and in other places, it's the norm. I'm proud to say Texas doesn't have too many petty rules (at least not yet).

We have these at work to comply with the insurance co.
They have to have a thermal shut off valve (in case of fire burns up hose) and a manual valve shut when not operating and a dead man valve on the end of the hose and relief valve, flame arrestor on the vent .

I have a overhead tank but 4 or 5 years ago when I was looking for one I could not find them. I called every co-op, farm store like TSC, and even the fuel delivery companies around here. All they had were ground tanks with 12 or 120 volt pumps. Anyway I was told they are no longer available due to good old OSHA. They say they are a tip risk, especially when they are getting empty. Seems more than one person has had them tip on them as they climb up on them to look inside and see how much fuel is left. I ended up building my own 300 gallon tank on a stand since
*I did not want to reley on a pump due to our frequent power outages.

Surley you're talking commercial establishments' here and not private homeowners:RITE!

Nope, applies to all who want fuel delivered. If you have a generator (~90 % of our neighbors ) and go Diesel (less than 1%) you run into it. Better to run propane or carry in gasoline in 5 gallon quantities. You have to have containment due to our drinking water being anywhere from above ground to no more than 10 ft down. The soil ( hahaha ) is about 6 inches deep until you hit coral rock.. Fuel will go to the water level even faster than rainwater. Southern tip of FL where the Keys start. Farm in Ohio has none of those requirements as the clay soil only needs bermed to stop rapid movement. We had to stop using a 1000 gallon above ground skid mounted gasoline tank or else we would have had to get a permit, install a containment system, monitoring system for leaks, and monitoring wells to keep it legal just to get fuel delivered to our home. And your records from the monitoring system will be checked yearly and you have to do a self inspection monthly plus printout the monitoring report weekly. A 55 gallon barrel of oil is required to have a containment system also. And yes, it can be a pain to keep up with all the requirements. Way around it is a trailer with a double wall 250 gallon tank on it. 250 gallon tank can only have 225 gallons in it.

Fuel delivery drivers have to see the permit for fuel to be delivered ( >250 gallons)which has to be posted where an inspector can see it. Plus they can inspect during normal hours of the day. IE 0700 to 1700.

Tank is allowed but not the filling unless mobile. You can have the smaller tanks but the dealers can't deliver. Bigger than 250 and even filling it yourself gets you problems. And it has to have secondary containment no matter the size. They check records from the dealers. Don't tell them, even more trouble if no permit. They also do arial surveys and spot things. Like new fences and structures built without permits. And we have a very active Building and Zoning and Dept of Environmental Resource Management departments. DERM even can shutdown Federal sites. They cut Feds and State sites some slack but only for 1 month. Second inspection things better be working right/corrected or the fines start. Basically, they don't want homeowners storing fuel.

As for #3, it's under way. Hope to be moved by the end of the year if the housing market stabilises.
