Unreal but true story.. Two summers ago, friend of mine is on his own farm. When he and his brother see 6 people on horses entering there pasture field. They <w/o weapons> drive up to them and simply ask them to leave. They had entered the field by cutting the fence BTW. OK, long story short, 5 men and one woman, all drunk and or high get chitty with the owner. Attack both of them, basically 5 on 2, beating them with everything they can get there hands on. My friend, on the groud now see's 3 of the men on top of his brother. Crawls to his truck and manages to get in. One of the tresspasers high on whatever stands between my friend and his beaten brother. Well my friend ran him over. Did not kill him but hurt him pretty good. In the end my friend <the landowner> is charged with felonious assault and pleads to much lesser charge. Slug sue's him and insurance company settles the case for 100grand.. Sad but true story.. Tied up in court for nearly two years. Settled 2 months ago. Landowner model citizen no trouble ever. Slug RAP sheet nearly 10 pages long.

In Missouri those trespassers would have been in serious trouble. Last August, Missouri amended the "Castle Doctrine" to include all of the owner's property in addition to an occupied dwelling. If the landowner feels his life is in danger he has the right to use lethal force anywhere on his property. Of course, good judgment is also necessary. In the above case, I think lethal force would have been justified as those guys lives were clearly in danger due to intoxification and drug use.
I have a permit to carry a concealed weapon (CCW) and although I don't always carry, its there if needed. It's too bad our society has deteriorated to the point of this becoming a necessity.

The outcome sucks! There are a few legal principles at work here.
Running one of the perpetrators down with a car; that is excessive force, you may defend yourself, however only with equal force. What is permissible, to legally defend yourself, one should have used a pipe of equal weight and dimensions.

The long criminal history has no bearing on the case. Each new charge must stand alone on its own merits, previous convictions may not be introduced, that causes the defends case to be prejudiced. Now if they were attacking the judge or DA then its ok, their special.

I don't understand how all six were not charged? It's clearly a case of your friends self-defense. Trespass, Assault with intent, under the influence, professional criminal, three strikes and your'e out.

I have 100 Acres of land about 45 minutes from home close to a very small city. I have a very friendly neighbor known by everybody to be innofensive to intruders. I made an arrangement with this very too good person... I asked him to start the rumor that I am a very crazy person and I would not endure intruders of any kinds on my property. I start showing up at the convenience store and the gas station with an hold duster and opening it to pay and letting people see the large knife on my belt. Doing some rude talk and showing absolutely no sign of the good person I truly am...

A couple month after the rumor started I thrown out of the property a teenager on atv while I was carrying my 30-30... I could see fear in his eyes.

I never used any kind of threats on him but this little incident sealed the rumors and since 10 years now I never had anybody else running on the property. At least nobody leave trace of their passage.

No need to say that my neighbor is also very happy not having to complain about intruders...

A good (or very bad) rumor will do more than any law or sign.

I have the same problem across the border in NY, except somebody escalated their tactics.

During the winter of 2000, one of my yearly colts was shot by a trespasser during hunting season while my wife and I were at work. The horse was standing less than 200 feet from a roadway and less than 500 ft from my home. I called the NY State Police and the Environmental Conservation Officer. The State Police did show up, but didn't do anything to investigate. The EnCon Officer showed up the next day, looked around and then disappeared. If this happened to them, I bet the outcome would be different.

Law abiding citizens/landowners have no rights and everything to loose.

Most of my neighbors are nice too, but I have 1 that's really like the character you created. He usually carries a S&W on his side. He caught some people riding 4 wheeler's on my land 1 night and threw some lead their way. They didn't come back. Some local meth heads stole copper wire from my tractor shed, so I put up a "camera surveillance" sign, and no more breakin's. One of the dopers OD'd and died, so the other 2 moved away. Good riddance.

I did drive up and surprise a fellow fishing in my pond 2 weeks ago. Said 1 of my neighbors (his brother-in-law) said I wouldn't mind. Well, I told him I wouldn't press charges this time, but next time ask. He was walking pretty fast as he was leaving. Glad he wasn't armed and hostile, as I was unarmed.

I think that would work here. Wisconsin and Michigan passed a law no trespassing whether posted or not. The law states you have to know where you are at all times.
