If you've ever been through this. Then, you probably know. All states have different laws concerning/ governing evictions. If you know what FL. law is then, just follow the law. otherwise, you could find yourself in court for improper eviction

I found a fl site that had the forms and the procedures to go thru. Not my tenant.. but I'm having to do the foot work for my parents who have a couple tenants that are now pretty much squatter / freeloaders..

Somehow asking for legal advice on a tractor forum doesn't strike me as a wise move.

I have in my rental agreement states the eviction process and exactly what sets in in motion for our rentals and they sign it after reading before moving in.

The actual notice can say out you freggin low life bum or you have 3 days to make payment or provide a really good excuse. It doesnt matter because the law is watching both sides of the argument in most states.

A lot depends on your contract how long the process takes is what my lawyer tells me and actually getting them to move may take some persuasion I am sure you can find something that makes it unlivable. good luck

In CA, and I suspect in a most other states, it is often a lot easier to go talk to them and say: "I will give you $300 if you are out by the end of the week and nothing in the unit is trashed."

Doesn't seem right, but it does save on them destroying stuff like they have a tendency if they get an eviction notice.

Probably need to look at what it actually takes in Florida to get them out including what the lease says. TN has one set of rules for property in the major cities and another set of rules for the rural areas.

I didn't read all of it, but you may want to take a look at what the Florida Bar Assn. has put on the internet about the eviction process in case your tenants start searching the internet for how long they can stay, what notice you have to give, etc. Consumer Tip: RIGHTS AND DUTIES OF TENANTS AND LANDLORDS

A slight variation on Curly Dave's method is how much of their deposit they get back, but usually they stay on long enough to make sure they've used up all their deposit money.

I hit the state site.. and downloaded the almost 10 forms I'll need, plus the process for our county, sheriff, and process server. big pita if you ask me.. at least there was a written lease...

Yes--PITA.

If the tenants are particularly troublesome, they'll dodge the process server to buy more time. Sometimes they refuse to come to the door to answer the deputy knocking at their door. It happens enough in TN that there's a procedure for the sheriff to serve them with process by tacking a notice on the door and sending them notice in the mail, but the sheriff's don't like the paperwork.

When you finally get them served with process and get a court date, then they'll stay on until their time for appeal runs. Finally, you have to get the sheriff to set them out, and by then they'll probably have moved on.

So you have to set deadlines and stay on them to run them out.
