"You must have a commercial driver license (CDL) to drive any of the following vehicles:

* All single vehicles with a manufacturer痴 weight rating of 26,001 pounds or more.
* All trailers with a manufacturer痴 weight rating of 10,001 pounds or more, and a combined vehicles gross weight rating of 26,001 pounds or more.
* All vehicles designed to transport 16 or more persons (including the driver). This includes private and church buses.
* All school buses, regardless of size.
* All vehicles used to transport any material that requires hazardous material placarding or any quantity of a material listed as a select agent or toxin in 42 CFR 73."

Can you show where it says you have to have a CDL for anything over 25,999# when pulling trailer?

I really don't like doing people's light work for them. A few simple keystrokes on your behalf would have proven my point.
My bad (it's been awhile since I've had a CDL - I was a test driver for PACCAR), the weight cutoff isn't 25,999 lbs., it's 26,001 lbs., two pounds difference.

Reading the WA regs, the only way I see you might try to slide past them is by saying your vehicle weighs <26,001# and your trailer is less than 10,001# and you therefore don't fall under the CDL because the reg says "...weight rating of 10,001 pounds or more, and a combined vehicles gross weight rating of 26,001 pounds or more.", and you're trying to argue that the use of the conjunctive "and" means that both premises must be met in order for the law to apply, and that as long as one is under the threshold you're home free. Wanna bet the judge ain't gonna see it that way on first hearing? I'll lay money the judge or hearing officer says that you're over the gross combined and pay the fine. I think you might *possibly* win on appeal but that's gonna be a costly venture.

Guidance: No to both questions. Although the vehicle has a GCWR of 36,000 pounds, it is not a CMV under any part of the definition of that term in ァ383.5, and a CDL is not federally required

You're talking federal, I'm talking State - Apples and Oranges. State trumps the fed if stricter.

But the state isn't stricter. WA has the same description for a class A as the feds do. Apple to apples.

I am just saying that it isn't as simple as this,

The whole combo cannot exceed 25,999(26,001) lbs. GCW rating. Over that you need a CDL.
