Here in Indiana its just like most states. You do not need a CDL until you are over 26,000#, give or take a pound or two, I can not remember. There is no 10,000# limit on trailers unless you are Commercial, ie for hire. There are also exemptions for farm use, personal effects, recreational vehicles, and boats.

So even for hire you could approach the 36,000# limit without a CDL by driving a truck that is say 25,999# and a 9,990# trailer. Many trailers with 5,200# axles for a combined weight of 10,400# are derated to 9,990# for just that reason.

Off subject but many single axle trialers are rated at 2,990# even though they have a 3,500# axle under them to keep them under the 3,000# rule many states have for requiring brakes.

Right here.

The whole combo cannot exceed [26000] lbs. GCW rating. Over that you need a CDL

It is not as simple as being over 26k. To require a Class A the trailer has to be over 10k as well as the combination over 26k.

What it comes down to is legal hair-splitting over a conjunction. The word "and" was used in that sentence about the trailer/tractor combo , and in legal circles the use of the conjunctive ("and") rather than the disjunctive ("or") means that BOTH premises must be met simultaneously in order for the law to apply. So, if the tractor is 26K (just under the individual limit for a CDL) and the trailer is 10K (again, just under the individual limit), you get to skate, since the law requires that the trailer must be over and the combined weight of tractor and trailer must be over 26,001# for a CDL to be required. So, you get a pass even though your GCW is 36K. This is one of those cases where the letter of the law is ruling, rather than the intent. Lobbyists at work snookering lawmakers who don't know the formula for making laws. Okay, that last is my own unsolicited opinion regarding lobbyists, but I'm that way. :)

The law should read that if you're over you're over and you need the CDL if you're gonna share the road with me, but it doesn't. It says that half-blind goobers with bad hearts and drug addictions can drive their overweight campers and trailers down the highway at 75mph while having a coffee in one hand and a cell phone in the other and you and I just gotta look out for ourselves. Okay, that's maybe a bit of a stretch, but you get my drift. :)

The same disclaimer about my lack of legal training and ability still applies - no matter how many times I say something I still may not know what I'm talking about. As a retired cop with 30 years in the game I can split hairs with the best of them.

I am such a moron, please forgive me all. I looked at the flowchart and see where I made my mistake, er, misunderstanding. I was assuming that anyone hauling 6,000 lbs. of ANYTHING, would be using a tandem axle trailer, with brakes on both axles, rated at LEAST 10,000 lbs. GVW. However, you can haul a 6,000 lb. something on a trailer rated at 7,000 lbs. GVW legally and pay the consequences only in the case of an accident. I guess then you could also plead ignorance. And as you all well know; "Just because it's legal, don't always mean it's right".
