And we can say "Thank God they didn't hit anyone else."

You mentioned texting. I am all for personal freedom and responsibility -- what you do is your business as long as you do no harm to others. That being said, I now cringe when I see another driver using a cell phone. I understand that some states ban driver's cell phone use while driving.

I saw a semi do this once. He did not peal off the barrier like these photos but he went bumpity bump along the rail for quite a distance.

He was lucky. The guard rail is on a causeway and it kept him from driving into a lake.

Later,

It isn't just drivers! Last week I was sitting at a light and a pedestrian comes moseying along in the crosswalk, cell phone to his ear. Trouble is, the light had already changed before he was in the curb lane. He stepped out from in front of a large truck in the left lane, who was stopped waiting for him to get clear, and walked into the curb lane which was empty. The guy coming through in the curb lane had to do a very quick stop to not hit him (but no squealing rubber). He continued on his leisurely way onto the sidewalk and never knew just how close he came to becoming a statistic. From the position he was in when the light went to green, I'm pretty sure he started to cross the street after the Don't Walk light had come on, probably because of the same lack of attention he was displaying right before he was almost ran down.

An it's not just texting, even though that is what they seem to only want to focus on.

What about fast food, playing with the radio knob, yelling at the kids in the back seat, reading a billboard, OR ANYTHING that causes you to take your eyes off the road or a hand off the wheel.

Fact is, there are already laws in place for "distracted driving". And it up to the descreation of the officer. It is a judgment call for them If you were being a danger to you/others they can cite you.

All they have done now is make it harder to enforce. Because it you issue a ticket for texting, now it is no longer a judgment call, they actuall have to prove you were texting. And the time and money spent to prove it costs way more than a $100 fine is going to pay.
