JLS : great dealer that went above and beyond/ MF did as well

As customer was out of warranty based on date alone i would have told him to pound sand. Especially after the threats.

On the disconnected tach.. that (and his attitude) speaks volumes to his character. I have no doubt in my mind he disconnected it to keep his hours down. Sure it could have vibrated loose, but i doubt it. Even assuming it vibrated off, he should have noticed it not moving and the tach not working with the daily use he said it did.

Now hes going to pawn it off on somebody else for more than its worth. Pretty scuzzy move considering somebody's going to buy it off the deere lot with all those hours on it and never know (overpay)

Its fraudulent as there is no real way to determine wear on a machine besides hours and appearance, no different than tampering with an odometer in a car.

Without discrimination in this instance means if you take plastic from anyone you take it from everyone. If the card is valid and the charge approved, a merchant who refuses to accept it as payment is in violation of the agreement he signed.
I don't like it but that is the way it is.

The dealer in this seems to be a man of character and integrity, so it is solely up to Mr. Smith how he proceeds.
I would hate to see him get in trouble and lose his ability to accept MC/Visa which would probably cost his business more in the long run than if the owner scammed the credit card.

I really wish it was different, but it is what it is.

Not if he thinks there is a probability of fraud in the works.

Regardless of what the merchant agreement says, it is still up to the merchant account provider if they want to enforce it. I am sure once they spoke with the merchant about this and got the whole story, they would not choose to enforce it. He is looking out for his business and protecting them from possible/probable abuse and or fraud. It would also require the cardholder to call and dispute the situation.

Then if he did want to dispute the charge... What is he going to tell them? He doesn't want to pay for a repair on a machine that is well out of warranty? I doubt they would allow them to dispute the charge for that. Particularly after good will has been extended as it was in this case.

Another option would be to call the card in for approval and inform them that cardholder has stated he intends to dispute the charge. Let them make the call knowing that.

Or, ahead of time you could call whomever your merchant account is with and explain the situation and let them tell you what you should do.

Sorry sixdogs. Well I called and left two messages today for the customer to call me and I have yet to hear from him. I have the tractor parked towhere he can't get it so im not worried about that. Hopefully ill hear something tomorrow.
