But they specifically and politely asked permission once they identifed the property owner....

They could've easily indentified me using our county's very good property tax records website, but chose not to. Like little kids, they decided asking for forgiveness later was easier than asking for permission beforehand ... which they wouldn't have gotten. Now they're really asking for both, even though they never actually asked for forgiveness for already haven trespassed.

doesn't that justify the courtesy of a reply?

No call = Implied reply

I understand being "neighborly" , but it's YOUR land. Do what you like, they have!! You don't need excuses, unless it is easier for them to except. Once you allow something, it's 10 times harder to change it later.

The fact that your land has been "designated" for public use would have p'd me too, that alone would tell me what I needed to know.

If they aren't happy with you for saying you'd rather not allow it, then they have something to "get over".

Sounds like they are being neighborly

They're being neighborly now ... but I don't think they were being neighborly, trespassing. And if their dobermans continue trespassing, I won't view that as neighborly, either.

Don't know what this country is coming to if we cannot be nice to our neighbors and instead need to treat every interaction as a possible law suit or think someone is trying to take advantage.

I can do both: What's wrong with being nice to them while also considering liability issues? BTW, being nice to them doesn't mean I have to say yes to their request to ride horses on my land.

If you were planning to build a house on the land you might want to make clear that they could ride until you develop it but if riding on your land isn't doing you any harm then why not let them?

I am planning to build a house there, & will probably just look the other way, ignore horse hoof prints, until we do. I don't plan to give them the all-clear, though.

I like this entire reply.

[IMHO]

There is nothing more annoying than a new neighbor expecting that just because they showed up, and they seem to think their poop smells like roses, everybody else that's been there forever had better change their tune to suit them....

[/IMHO]

If that's aimed at me ... Yes, I'm the new guy. But, I bought the land. It has my name on it. I pay the taxes. Nobody else chipped in. It wasn't a group buy. It's not a commune.

If I wanted to share the land, I would've not actually bought this land & would've instead gone to a park.

I'm the new guy around here also. I worked hard and bought the land. Forever am I not going to carry pepper spray and a firearm on my own property. I will eliminate the source of fear first. As far as waivers go it is as our insurance agent told us years ago. "It depends on which lawyer the judge goes to bed with on that particular day."

I'd suggest you tell them no re: riding their horses on your property, but do it in a way that makes it look like you are really looking out after their interests and that you'd like to let them ride there but you can't because it really isn't safe for them or their horses (you really love horses even though you don't own any) and you just couldn't live with yourself if you let them ride there and they or their horses got hurt in any way.

Does the law really respond to trespass and stray dogs calls where most of you live?

I live in a city of 450,000 and the law is very selective to what warrants an officer to be dispatched and will instead send out a form called "Citizen Incident Report" to fill out and mail back...

If you are going to be able to deal with unexpected situations which might come up on your property, or even off your property, you will be far better equipped to do it if you are armed.

I know I just can't control every situation on my 40 acres like I could on my suburban 1/4 acre lot, but I also know I am far more in control with a revolver than without. Whether it is a carload of low-lifes coming up my driveway to look things over, a cougar eyeing me & my dogs, or an injured deer, being armed is very convenient. Just part of country living.

* * * * *

As far as liability for anything goes, a $5 million umbrella policy costs me about $250 per year.

That lets me say "yes" to a lot of stuff that is neighborly and lets me be part of the community without having to worry about liability and the remote chance someone might get hurt on my property.

When I first bought the property, there were a couple of high school boys who sometimes took their dirt bikes on my property. I was friendly to them and never chased them off. As we built the house and developed the property, they found other places to ride. Problem solved without confrontation. If I had chased them off, their parents would still be enemies...
