Does the law really respond to trespass and stray dogs calls where most of you live?

I live in a city of 450,000 and the law is very selective to what warrants an officer to be dispatched and will instead send out a form called "Citizen Incident Report" to fill out and mail back...

Strange that an officer won't come out. Seems contrary to "keeping the peace".
People in your area should not tolerate such behavior.

As far as liability for anything goes, a $5 million umbrella policy costs me about $250 per year.

I do have a $1M umbrella now (whereas I'm not sure my parents, discussed above, do). I will ask State Farm if that would cover a horse rider on my vacant land. Still probably don't want them riding there, anyway, but maybe I'd feel differently about it with essentially no liability. (I did start reading EarPlug's links, but haven't finished)

When I first bought the property, there were a couple of high school boys who sometimes took their dirt bikes on my property. I was friendly to them and never chased them off. As we built the house and developed the property, they found other places to ride. Problem solved without confrontation. If I had chased them off, their parents would still be enemies...

Since I probably won't chase off the horse riding couple, this is probably how my scenario will play out.

Police Depart was cut 10% or 80 sworn officers...

Two weeks ago my uncle received a call that a neighbor saw two guys go over the 8' fence with a duffel bag... my uncle called the police and said he would be there in 5 minutes... police told him to call once he got there. The thrives had used bolt cutters and started to load up equipment in one of the trucks they had broken the locks...

Uncle ran them off while on the phone with 911... he was told to leave because police would not be responding due to low staffing...

It's political as much as anything... citizens passed several parcel taxes to guarantee minimum number of officers and the money went to general fund and now city is putting more tax measures on ballot...

Police Officers... even those that retired 30 years ago have a special pension kicker that increases their pension based on the current pay of an officer of the same rank... talk about cost of living adjustment... just about all are making more to much more than their pay at time of retirement.

Anyway... looks like individuals are going to be more on our own and discharge of firearm is prohibited within city limits...

Dogs can be very dangerous and know several injured by family pets running loose... I would be wary of any strange dog on my land that acted aggressive.

If you already have $1M check on $5M. I think it was about a $30 upgrade. Some agents don't like to sell that size for some reason, I had to look for an agent (State Farm also) who wanted all of my business, instead of telling me what I wanted.

Hard to say what to do... I recently had a similar problem. I got a donkey (miniature) in hopes that it would discourage the dogs from coming onto my land. The bad thing is, it is not the dogs who are at fault it is the owner! The only difference in a wolf and a dog is that the dogs are domesticated. The operative part of the word domestication is "dom" to dominate, the human is supposed to be dominate over the dog, to control their actions, those owners who do not control or dominate their dogs are doing the dogs a great disservice.

Just play it cool and do nothing..It is a given that is YOUR property, so just act like it slipped your mind with all thew other stuff you have to do and see what they do..Maybe they will take the polite hint and respect you.

More than a few years back, CowBoyDoc, posted a story of a landowner that was sued by people horse riding on the landowners property. The land was not posted and the people rode onto the property. One of the horses stumped in to stump hole and threw the rider who was hurt. The land owner got sued.

Someone posted links to FLA laws which you should read.

In NC, the extension office has a paper about landowner liability. The big thing one can do is post the land. If someone is on my land and they stumble and get hurt they will have a tough time suing since they were injured while committing a criminal act.

I bought our land to have as much peace and quiet as we could afford. We do not want other people on our land. If they want a park then they can go to one. We have had enough problems with people using our land as a dump or poaching. Our land is heavily wooded with stump holes, stumps, and rocks all over the place. One never knows what widow makers are hanging in the trees.

We do not need the aggravation of other people on our place. Nothing it in for us but problems.

We carry a large umbrella policy in any case.

Later,
Dan

Don't underestimate the danger of this situation. You are dealing with a pack. Two dogs should never be allowed to run together in this manner. The potential for tragedy is is very real. I invite every one to google Leerburg kennel and view his articles on dog aggression and bites. A couple was convicted of murder for their 2 Rots. killing a boy. Perhaps downloading these articles and giving them to your neighbor Will instill some responsibility in him. In the meantime carry bear spray and a gun and be mentally prepared to use them if necessary. These dogs can kill a child in a heartbeat. Its a shame that you can't use your property without fearing for your and visitors saftey. It's almost like being in combat.

If that's aimed at me ... Yes, I'm the new guy. But, I bought the land. It has my name on it. I pay the taxes. Nobody else chipped in. It wasn't a group buy. It's not a commune.

If I wanted to share the land, I would've not actually bought this land & would've instead gone to a park.

No, actually it wasn't. It wasn't 'aimed' at anyone, it was a statement, (an opinion at that) and the next sentance you deleted also gave some context to what I was responding to.

You bought it? You pay the taxes? That's just ducky - so did and does everybody else, you may or may not want to start calling the cops on because they are doing something on THEIR land YOU don't like. IMHO, that's just tough.

However, most locales don't like you letting your dogs go wherever they think is their territory - which was the start of this thread. That then isn't an opinion, it's against the law. BUT.....what does it hurt to just try and talk before you call in the sherrif? Why does everybody have to be so defensive about this? Nobody said go and beg the neighbor on your knees to control his dogs. Just a chat. Why is that so offensive an idea? If the guy's a jerk, call the cops every time he farts.

We wonder why we're so divided as a country.......here it is. We can't even suggest talkng to your neighbors without half the group feeling they got their toes stepped on. :frown:
