Years ago, seems like it might be five years at this point, a landowner in a county NE of us was having problems with ATV's on his land. He posted and maybe talked to them. In the end he put a cable across the road which is common in my area of NC. I think he had it flagged as well.

At dusk, a group of ATVs went roaring down the road. The cable hit one guy in the chest and killed him.

The Sheriff did not press charges since the ATV's were trespassing.

Never did hear if their was a civil action.

I have long thought of putting a sound system on our road after the gate and trespass signs. When a car goes up the road the system would play Dueling Banjos. ;):D

Later,
Dan

Unflagged cable here is a big no-no. I had trouble with ATVs from the neighbouring property cutting fences and driving over trees in the fence lines to get onto ours. I fought for years blocking their paths, repairing etc.

This summer I opened the gate to that property and left it open. The first week a pile of tracks. After that... nothing. All these people that just had to see what was on my property realized there's nothing to see, no good trails, and no good access to the logging road next to us.

Last fall I purchased 40 acres of land 1/2 mile from our cabin...somewhat remote in a logging and hunting area.

The 40 acres had very nice trails from earlier logging and has been used by some over the years for hunting and trail riding. In fact...I hunted on the property when I was about 18 years old...now 63 :) Also has major blueberries patches.

My "plan" is to first make it clear that some one "owns" the property as the area has lots of state and national forest and people are used to using land if they think now "owned" by private party. First, I have mowed the trails and cleaned all deadfall. My mowing makes it pretty clear that the land is "owned".

I have not had damage issues...just either hunters, blueberry pickers or trail riders using the property as they have for probably 50 year+.

Next summer I am going to put some decorative fencing in the entry and may put up a mailbox. Also, when we see berry pickers we let them know the land is now private. We are not near any town area and so most who use the land do not damage...at least so far. I want to slowly establish the private nature of the land.

BTW..."blocking" the entrance roads (3) will likely result in mowed down small trees creating a new atv path into the trails.

We will play it by year and see what happens next year.

Did have one "issue" this spring...found two dead timber wolves at the end of our road...just about 10 feet into the woods. In that case we notified the DNR and they came and picked up the carcasses after they were done "rotting". Said they are unlikely to find the culprits but want the skulls for study. My concern in this case is that someone would call and the DNR might think I killed the wolves.

FWIW...TMR

Tmr, good luck. It sounds good and some people will respect your wishes as the new owner. There seems to be a few whom won't abide, but let us know how it goes?.

We were part time residents for a long time. One of the most valuable things to me was to make good neighbors.

One of my neighbors didn't own a tractor :confused2: and cut his field with a riding mower. I offered to bring my tractor over, and would bring soda (the brand that his wife likes is not available in our area) when we came up to "visit" our property. We made the rounds to all our neighbors and introduced ourselves, etc. A few didn't want to be bothered, but most were happy to keep an eye on our place when we were away. One of my neighbors even chased away somebody "who had taken a wrong turn" down my road one evening when they saw carlights when no one should be there!

Ours is a small community, and the "old timers" knew who was doing what as well!

We once had a problem with dirt bikes - kids by the look of it. I asked one of the neighbors and he knew exactly who it was tresspassing, and where they lived. I went to visit the parents (politely...) and the problem stopped.

If you can't be there full time, take advantage of the people who are!

What would you sue me for? Is it illegal to put a fence around your property where you live?

In Fla it has to be four wires to be called a fence

I know of some farmers kids one time that ran over a freinds hay ground and tore up several months of work he had donw sprigging bermuda. One of their wives talked basd to him and told him they rode where he wanted. Later that night cut across a bean feild with a 14 foot disc. That was the last time that happened.

Funny story: A client of mine farms 250 acres or so and got a call from one of the neighbors one day asking if one of his vehicles was stuck out in the back field. Client said it wasn't his but he would go check it out. Found out it was the neighbor kid's car who used to work for him and was out doing some mud-bogging in his fields. When my client saw the damage this kid did he was none-too-pleased and thought about how to best handle things. The next morning he loaded up a full load of manure and pulled it out to the stuck vehicle with his tractor. Backed it up nice and close and well, just let-er-fly. Best part about the story is that the kids windows were stuck all or partially down.:laughing: I'm pretty sure he hasn't been back!
