Why don't you call one of the local County Transit Systems and find out if this is concurrent with their hiring practices? Then I would set up an appointment for a Free consultation with an Attorney and see what he thinks. I agree with the other members in regards to the possible legalities. But who knows? Many businesses now, will not hire people who smoke tobacco. The Courts have ruled that this was not discrimination, because "Smokers" are not covered and protected under basic Discrimination Statues. The best of Luck.
