Do you think it was unjust for Monsanto to sue this fella?

Monsanto ~ Percy Schmeiser

Very interesting case. Read some of the actual judgments. Monsanto's won greater protections in Canada. The farmer didn't have to pay any money to Monsanto, but he lost HIS Canola seed that he had been using for 50 years. So if a patented seed gets into a traditional farmers land through no fault of his own, he no longer can save his seed. Sounds like the lawsuit was correct, but it highlights the danger of being able to patent a seed. It sounds like he knew some patented seed got into his field, but he didn't plant it and then use Roundup on it.

Are you referring to the farmer in the link posted?

Because he hadn't been using that seed for 50 years. He carefully selected that seed out by spraying the rest of his crop with round up.

Nothing is stopping a farmer from saving his own seed, as long as he didn't buy the original (GMO) seed stock and sign a user agreement. This character systematically selected out the RR seed and propagated it.

I certainly am. I quickly researched the case you referenced. Of course both sides claim victory, so you really need to read the actual judgement.

From what I quickly gathered, he had been using his own seed for 50 years. A farmhand sprayed roundup near the field near a post. It was discovered that some of the plants near the spraying died while others didn't. He had an area sprayed and found that he had a fair amount of the plants resistant to Roundup. He then collected seed as he always had. The next year it was determined that a significant portion of his seed was Monsanto's patented seed. He never sprayed it, and it appears he never benefited from using the patented seed. Monsantos claimed patent infringement and wanted their contractual $15/acre, and he claims he never signed any contract with them nor benefited. Court ruled, he didn't have to pay because of no contract nor benefit from the patented seed. He did have get rid of ALL his seed and buy new for the first time in 50 years.

I only read quickly, so I'm sure I missed some points. You can fill in any important facts for me.

Five years After Monsanto Ruling, Oakhurst Dairy Feels Vindicated

PORTLAND, Maine (August 13, 2008) When the announcement came last week that agribusiness giant Monsanto was getting out of the dairy hormone business, it was a victory of sorts for Maine-based Oakhurst Dairy. Oakhurst was the first major dairy in the country to reject the use of artificial growth hormone in the production of its milk 末 and to put this information on its label in the form of a Farmers' Pledge: No Artificial Growth Hormone Used. Five years ago, Monsanto sued Oakhurst, alleging that its label misled consumers into thinking there was something wrong with milk from cows treated with artificial growth hormone. In a David and Goliath contest that had nationwide implications, the independent, family-owned dairy fought Monsanto to preserve the right to inform customers that Oakhurst milk is produced without the use of artificial growth hormone.

Monsanto's rBST rBGH Pus Milk (interesting article)
"FOX News unintentionally broke the story about how Monsanto is poisoning our milk and dairy products. Monsanto sells 'posilac' to farmers > farmers inject posilac into milk producing cows under the premise that the cows will produce more milk > the cows get sick and develop acne-like sores (including mastitis on their udders) > the farmers inject antibiotics to keep the sick cows from dying.
Meanwhile, children in American Schools are drinking milk from sick cows that STILL contains Monsanto's Posilac, the antibiotics, and pus that drips from open sores on their infected udders into the milk buckets.
In the wake of mass consumer pressure, major retailers such as Safeway, Publix, Wal-Mart, and Kroger banned store brand milk products containing Monsanto's controversial genetically engineered hormone rBGH. Starbucks, under pressure from the OCA and our allies, has likewise banned rBGH milk.......
A recent court ruling found that there **ARE** THREE (3) differences between ORGANIC and rbST/rBGH Monsanto pus milk:
HORMONES in the milk can cause CANCER
Up to 20% PUS content (white blood cells)
DEPLETED NUTRITIONAL VALUE !!!"

Do you believe what read from a blog that labels a picture of a woman milking goats as "Milk Factory Cows"?

I see the goats, but I don't see the labels saying they are cows. I just thought what a spotless milking operation.
Our local paper had an article saying that cows useful lifespan as milkers was 6-8 years, then they were burnt out health wise. As a kid I remember cows easily being milkers twice that age -up to 17, 18 years. I asked a local farmer and he blamed it on the growth hormones they use. The blog just just seemed to be more of what I had been hearing already. And we drink Oakhurst milk frequently. Once in a while we use Oakhurst's heavy cream in our coffee! That is good!:licking::licking:

Chinese babies growing breasts from milk hormones?
Chinese babies growing breasts from milk hormones?

"Dairy cow growth hormones are linked to cancer in humans. The number of residual hormones found in cow milk is as much as 10 times higher than non-treated cows.3 Several studies have linked these high levels of residual hormones to an increased risk of breast, colon, prostate and lung cancer in humans.
Growth hormones can cause early maturity in humans. In the late 1970s, the U.S. banned a growth hormone (DES) known to cause cancer. Rather than destroying the leftovers, the manufacturer shipped remaining hormones to Puerto Rico where the farmers liberally injected their chicken, pork and beef herds. Shortly thereafter, thousands of children as young as two were found to have reached full sexual maturity. The cause was residual DES in meat the children had consumed.4
Milk from treated dairy cows may have residual antibiotics. Cows treated with bST have a higher rate of udder infections which the farmer treats with antibiotics. The antibiotics do show up in that cow's milk, and if the farmer does not allow a sufficient withdrawal period, the entire milk supply could become contaminated."

Put politics and your feelings on Monsanto aside. Do you really want to eat food that is resistant to one of the most potent chemicals to agriculture there is. Plants get their nutrients from the soil where all this chemical gets to collect in the plant.

The same with cows drinking milk full of growth hormone and antibiotics. Or even eating said cows as it all collects in the meat and fat of the animal. We have such a disconnect with how we get our food that most don't realize this is happening to them. The fact that there is no labellings for such food is just criminal at the worst and deceitful to say the least. All that dairy did was say we don't do this (good for them)

So ask your self do you really want to ingest this, do you want your kids to ingest this and your Grand-kids. if you answered yes to any of these bon Appetite. I will grow and raise and milk my own food and deal with the small scale farmer who does the same.

So control your weeds and bugs conventionally. Problem solved. Where is the issue?

The problem is, around here anyway, that there seems to be a new type weed every year. This will be the first year my wife's operation is planting Round-Up ready field corn for grinding into cattle feed. She's tired of battling acre after acre of weeds with cultivators, including foxtail, pigweed and now giant pigweed(which is becoming Roundup resistant). It's a constant battle so she's going with the Roundup-Ready stuff this year and see how it goes.

I am still not buying it.

Seems to be to many variables.

RR seed is introduced in '96 but 2 years later his seed is ~98%RR. That didn't happen by accident.

Pretty tough to grow a crop for 50 years when it was only developed in the '70's. :)

I see the goats, but I don't see the labels saying they are cows.

Drag your cursor over the pic.

I just thought what a spotless milking operation.

That it is indeed.

Our local paper had an article saying that cows useful lifespan as milkers was 6-8 years, then they were burnt out health wise. As a kid I remember cows easily being milkers twice that age -up to 17, 18 years. I asked a local farmer and he blamed it on the growth hormones they use.

We never used growth hormone and rarely milked a cow for 8 years.

Many of these big dairies in the hot south and west only a milk a cow for 1-2 years. Some don't even breed them back. This is blamed on the heat as far as I know. I don't know how prevalent hormone use is there.

Put politics and your feelings on Monsanto aside. Do you really want to eat food that is resistant to one of the most potent chemicals to agriculture there is. Plants get their nutrients from the soil where all this chemical gets to collect in the plant.

What do you base the bolded comment on?

Glyphosate is a moderately toxic herbicide and carries the signal word WARNING on the label. Even though the LD50 values show the compound to be relatively non-toxic it can cause significant eye irritation.

The LD50 of Caffeine is 192, Salt 3000, Gly 5600 and Atrazine is 3090.
