BTDT it purely sucks to have neighbors dont it. :mad:

A properly surveyed plot is mandatory and at that point get a real good property lawyer do not escalate it by retaliation you will lose in every way and never get justice. Fences make good neighbors always keep that in mind.

If you have your attorney PM me I have a piece of Kansas easement case law with my name on it and my check stubs to prove it. I can direct your attorney to which we won all the way to the top state court level btw.

I am not a lawyer but a prescriptive easement in my estimation is something used when someone is land locked or has been using a certain property for over 14 years etc. So not quite understanding why there is an issue but anything is possible with the liberal land grabbing unconstitutional courts these days. good luck

He obviously dumped the fish near the line to tick you off.

His tactic worked.

You don't want him to trespass on your land. Don't trespass on his. He is a bully and he is trying to push your buttons. Only YOU can allow him to ACTUALLY push your buttons. As others have said, document, document and document.

Not sure what the law can do about his dumping the fish but that is all you can legally do. Illegal dumping might be a charge depending on state law. In any case you would have had to have seen him do the dumping. Your county/city might have regulations regarding open trash/dumping. This might be able to help you since those regulations might not care about WHO did the dumping only that the landowner clean it up.

When we lived in the city we had some problems with the people living next door. Eventually what got the problem solved was not our multiple calls to the POlice, though it might have helped, but code enforcement. Code enforcement solve the problem. But we and the other neighbors had to figure out which buttons WE needed to push to get the local government to solve the problem.

These issues can get very nasty. People have been killed over these sorts of spats. There is a thread by MDBarb, regarding an easement, that lasted years. I believe that TBNer MDBarb was in the right. In the end he lost in court a couple of times. I believe he lost hundreds of thousands of dollars and went bankrupt. The last post from him on the thread shows he still is having problems with the people until late last year.

Wish you didn't already have the court mess. Best way I have found to get someone to steer clear of me is every time I see them ask to borrow something. Nothing valuable, just something that would annoy them , like ask to borrow a plunger, or a single AA battery, anything. After just a short while they will dodge you like the plague.

Nice idea... I'm going try it with government types too

I have to ask.. Are you sure he doesn't read TBN? :D I've been really lucky.. I have the best neighbors around.. For the most part we wave and say hi, and once in a while we chat in the yard.
I have to agree, I'd let the guy dump his trash. Not sure where you live, but out here, if someone dumped, heck even buried fish it wouldn't be there more then 24 hours before something dug it up for a snack.

I have to agree, I'd let the guy dump his trash. Not sure where you live, but out here, if someone dumped, heck even buried fish it wouldn't be there more then 24 hours before something dug it up for a snack.

Fish makes great fertilizer. Turn over a patch of dirt and start a garden. Tell him "thanks for the fertilizer, I'll take all you can get".
he will stop dumping the fish.

Oh... and the patch of garden, should be located so he has to drive over it to get to his property, now he's destroying your crops.
He's frustrated and you have fresh vegtables.;)

I know I can count on varying opinions as to what to do here.

Background: I have a neighborhood bully who wanted to drive across my property to get to his although there was another road 20 yards away that he has been using and maintaining. We told him no and he sued us for a prescriptive easement. The case is almost a year old with no progression. His property line is about 100 feet from our house/cabin.

So for the past 2 weeks before Memorial Day, I was building a nice 20' x 12' deck off the house. Saturday we smelled a fishy smell that was bad. Lo and behold he had dumped about 30 - 40 dead fish and parts on his side of the property. He has done this twice previously in small amounts (3-5 fish) and we just shoveled it up and disposed of it properly. This time it was overboard. We called the Nebraska Game and Parks Game Warden to file a complaint because it was disposed along "a body of water" a direct violation of game laws.

My question. What would you guys do? Load it into the bucket of my tractor (Tie to TBN) and dump it on his front porch? let the law handle it? or???? BTW he has about 225 acres where he can dispose of this stuff. I have to leave soon but will check back in the morning for your thoughts.
