Now just in case I didn't confuse you enough with the last post:p
here's a little more to chew on:D

While I was present when my tree guy planted the new trees, I didn't pay close attention to the exact tree line placement. As I previously mentioned, the surveyor told me the mature trees were 8" off the line...not ON the line as I had assumed all along. I instructed my tree guy to follow the existing line for planting the new ones. And I should add he did an excellent job because if you sighted it by eye, they lined up perfectly...all 140

However, what I found today is that the midway pin(B) location is 26" away from the tree line. The other 3 pins that I installed in place of the woodstakes were 8" away. UHH? Something skrewy that's for sure. Maybe the 2' rebar pins I placed moved? Hard to believe they moved that much, but what I also found was that they were buried a good 6' below grade even though I installed them flush with the grade. So now that I question the location of these 3, I feel pretty confident I can locate the exact line again by using pins A and B to find C

Agree?...disagree?...?

Likely some will suggest hire the surveyor again but I'd rather not at this time if I can help it. Holidays and all that goes with it, that $200-300 is needed elsewhere:)

A lot of words written there so I need time but if you are 3 ft away from the property line, that is plenty and all you will need. Also, if you are hitting a branch or whatever, you can cut it off and it will grow back fine.her than that, your way of measuring is what I would do.

Also, I really hate to see you move all those if you don't have to. If you are far enough away from the line I'd call it good.

Oh, I suspect you are OK but if there is any doubt on the survey, spend the $$ and and save the ghost of Christmas' future. Just my two cents having been there an ddone that.

What else did you do to escalate the situation? How about breathing. As you know by now, there isn't a thing you can do to make this guy happy. The more you post, the more I think you are being reasonable.

LOL I think your right with the breathing. The neighbor knew I was out and about this weekend measuring and whatnot with the trees. Surprised he didn't pay me a visit knowing the nosey nancy he is. No doubt he will when I start the digging...it'll be interesting to hear what he says when he finds out my plans.

Thanks for the vote of confidence or better yet, agreeing that I've been reasonable. I tried my best...

Sorry for all the wording sixdogs...hard to explain but easy to see.

At the corner where the mature trees are, the trees are off about 8" from the pin...easy to see in the picture and I NEED to move them to 3' away. Halfway down the driveway the next pin(midway pin-surveyor set it) is 26' away from the trees...which seems odd and I don't recall it being that much but never measured it either The neighbors corner with the missing pin is easily 8" away, maybe more based on pics and memory. Currently there's a bare dirt spot where the pin used to be and I can narrow down where the pin should be within 4-6" or so. No way does the tree line have a curve in it.

Hence my need to accurately locate pin C by aligning pin A to pin C and working from that.

Or higher the surveyor again...sigh!

BTW...thanks sixdogs for your pics and the link to your thread about transplanting. At least I won't have to keep pestering you with questions about the transplant since my tree guy has my back

Maybe I should give up while I can lol

Try these 2 pics...

Pin A is 8" away from the tree line next to the transformer...surveyor set it
Pin B is 26" away from the tree line...surveyor set it
Pin C is missing(surveyor set it) and approx location is at least 8" away from the tree line maybe a bit more

My thoughts are forget about the existing tree line entirely for the sake of this explanation. It may look straight but somethings off. Since the survey is gospel...so to speak...I'll start at pin A and pull a string all the way to C while aligning it to B. I do know for a fact that the boundary line from A to C is a straight line.

I'm trying to find C without hiring the surveyor again and I ~think~ I can do it

Yeah, you can do it that way and I have done so on different situations. Sure wish you would plant a row in front of those trees and let him trim the others if he feels the need to. Of course he would need a survey to make sure he didn't overcut any of yours. Then he could pay for it, which he wouldn't want, and would likely just leave them alone. It's win-win for you and he gets to pay for the errors of his ways if he wants to trim your trees. You come out on top.

I see the things you mean with the pictures and you are going the right way. If things materially change or if behavior is out of context with prior experience, get the book. If you do move them make sure you have sufficient hose to reach and know that the next couple--three years are not yours. While others are frolicking in the sun on July 4th, you will be watering those trees. I know some easier ways but more on that later.

Part of neighbor problems happen when one is too nice and there are not clearly defined behavior borders. It started out OK but your kindness was perceived as weakness and he tried to get a leg up on you. When the border is defined again and on your terms and not his i believe his attitude will improve towards you since he now knows the limits. I've seen it before. Good fences do indeed make good neighbors.

Believe me I know what you are saying, I know what it takes to keep these healthy. I've spent some serious hours out there watering over the years which is why all the trees are thriving so well. 400' of 3/4" hose and a well that easily delivers all I've ever needed.

As for planting a 2nd row...just not there yet. Thought about it and think my plan suits me better. After I get the new line set and see whats what, I'll rethink your suggestion

Well- looking from the air- that is a beautiful job done on the treeline.

after seeing that, I'd recind my previous comments and say leave it as is. A side question- what is the zoning requirement for offset of a driveway or road from the property line? Where I am, it is well more than 15 feet. Is your neigbor compliant with the offset required?

I know this is a little off subject but arborvitaes can get decimated during a wet snow when they get big. Happens here in SE PA all the time. The snow knocks them down and breaks branches.

As far as the survey marker is concerned, I think I would contact the survey company and see if they will just come out and have a look. I would want the markers I paid for ... where they belong.

I have a couple of minor disputes with a neighbor on my back property line. When we moved in back in 2000, they had just built these large homes behind me. His yard slopes down to my back yard. The freak had a landscaping company come in and dig trenches on both sides of his house, running down to my back line. He had them install corrugated plastic drain pipe to direct ALL of his gutter storm water right up to my property line. I could not believe how blatant he was. I took a drive around the neighborhood and stopped in to have a talk with him. He claimed it was only temporary so he could get his grass grown in. I said... how come all your neighbors who have similar slopes have beautiful grass and did not do this? Didn't matter what I said. I took pictures. Long story short, time clogs drains... then he had a swimming pool installed a couple of years ago so it's a non-issue now.

In the other dispute, I had a lot of trees taken out of my back property. He got upset about it because they enjoyed the privacy. I had to remove them to build a garage. It was none of his business. So to at least be a good neighbor I said I was going to plant a row of fast growing evergreen trees on the property line. When I got the trees (yoshino cypress) and planted them, they happened to be on vacation. When he came home we talked about where I planted the trees... whether it was on the line or not. We had no survey markers that we could find. I told him if he didn't like them I would remove them. He said "I'll plant my own". So I removed them and planted them along the others at the other neighbors line. The point here is you can force someone else to pay for the survey if you intentionally encroach on there property. I didn't intentionally do it because neither of us knew the exact line. He was too cheap to bother an so was I. Eventually he put up a white plastic fence and planted a bunch of leyland cypress. Ends up mine look much better than his unplanned mess. I stay polite regardless.

BTW I think phone and electrical equipment are pretty much utility rights of way. I could be wrong.
