Paragraph 6 only lets you cross the pipeline with streets and roads. It sounds like it prohibits you from installing utilities across the permanent easement. That paragraph may contradict other parts of the contract and should probably be re-worded.

Looks like paragraphs 5 and 6 may be contradiciting teach other because 5 says that :
Grantor may also construct and/or install water, sewer, gas, electric, cable TV, telephone or other utility lines across the Permanent Easement Property at any angle of not less than forty five (45) degrees to Grantee痴 pipeline, provided that all of Grantee痴 required and applicable spacings, including depth separation limits and other protective requirements are met by Grantor.
I would want to get in writing (as an appendix?) what the "required and applicable spacings, including depth separation limits and other protective requirements" are and ensure that the pipeline depth will allow those to be installed.

I can tell you how I stopped a pipeline going through my property, ask for a lot $$. They wanted to go through the center of my orchard and half of my crep land. I told them it would cost them. Had a higher up call I increased the price and told them it would cost them. Had the boss call wanting to address my concerns I raised the price again and told him not to call me until the pad was in place then I would talk. Last week I saw flagging for the pipe line on someone elses property. I never wanted the pipeline I would never have made any money from it, I am glad its not on our property.

IMHO, that article is a must-read for anyone dealing with a proposed ROW. If you don't fully understand it, talk to an attorney who does.

Forgeblast is right. If you think the "worst-case-scenario" is where the pipeline company takes their money and goes across your neighbor, think again. The worst-case-scenario is where you discover later on that the easement prohibits you from using your land in a way most beneficial to you, and the value of that lost benefit is much more than the chump-change they paid you.

In too many cases they won't take their money and go elsewhere because they don't have to. Don't count on being able to just tell them that it will cost them and keep them off your land.

It's rare when the landowner comes out on top in a fight with a pipeline company.

Pipelines must be like wind farms in Ontario. The Ontario Liberal Government made an untendered $7 billion deal with Samsung and passed the Green Energy Act allowing industrial wind turbines to be built within 550 metres of residences with no democratic input from residents or municipalities. The windmills are unsustainable and grossly inefficient and need huge subsidies from taxpayers for the wind companies to make any profit. It makes pipelines look quite benign.

With the older leases, pipelines were not addressed. The landmen left that for others to worry about, they were after leasing land for the well pads. Which then leaves a lot of ticked off people with older leases who have been dealing with the companies for a while now and realize that to them time is money. Every day you hold them up every delay they have cost them money. They will go the easier route. Just be a thorn :)
