Problems with Trespassers

Threads like this I do an "advanced search" for the OP's name and skim the rest. He last posted back at 188.

That's great advice. Too many internet heroes.

Let me get the BIG GUNS started again......a REAL MAN doesn't have to hind behind a gun! There I said it!

To the OP. please keep us posted........I think so far your doing the correct thing.

Wow.....interesting thread. A plethora of personalities checking in. :fiery: Thanks to J F for adding some much needed humor.....:D

As I see it, Timm250 is handling the situation well. Get the survey, get the post hole digger, put up posts and barbed wire. Maybe electrify wire?? Post signs.

In that acute incredibly stressful scenario, the mind is working overtime on what to do. Having a weapon onboard could help you or hurt you. If the actions of several posters had been taken, retribution would surely have followed. Not to mention jail. And court....and $$$$$. There is not 1 correct answer for every situation.

Arming yourself might not be a bad idea given the situation. Particularly when you are digging postholes and stringing fence. And it doesn't have to be a gun. Conside the strongest pepper spray made. It will put a man down...quickly. Or several. I have a can of pepper spray combined with an electric probe...hope I never have to use it!

Best of luck with the situation.

The officer was wrong.

The officer might not have been able to make an arrest because he did not see the assaults depending on state law. However, he had EVERY reason to believe the OP and he SHOULD have trespassed the other people. That does not mean the officer had to arrest but just tell the people to leave and not come back. This depends on state law and department policy. If the officer did make an arrest, let the judge and/or jury figure out who owns the property. The officer handled this situation poorly. He had every reason to believe the OP and none to believe the mob. The officer has a family with children surrounded by a mob. Duh. That situation needs to be descalated.

Depending on state law the OP might be able to go to the magistrate and swear out warrants on the people who assaulted his wife. It appears the OP has witnesses but will they testify?

The cameras are a must in this situation. At a minimum, pulling up the the fences and taking down the signs is a destruction of property and/or theft. Cameras that cover the property markers would be a very good idea. I suspect they will go after them next which is another violation. Given the seriousness of this situation I would be talking to the officers supervisor or go to the Sheriff. Not quite sure how I would handle this one. Start low and work your way up or just go to the top.

Good Luck,
Dan

Update. I got an email yesterday morning from the deputy that responded when they were riding the chopper in the field. He has taken the pictures thst were on my game camera & the survey/deed to the property to the County Attorney. Charges are being filed & a warrant will be issued & be ready to be served on Monday. So I guess we will see how things go from here.
