Sounds good on paper. If he is legit or scared he will get on the ground, If not, he will attack you very quickly or run. If he lays on the ground or runs you don't shoot. If he attacks you, shoot. You have just escalated the situation into a 33.3% chance you will have to hire a lawyer.

I will and have took my chances on situations like this.
Well seeing that it ended well, I am glad that it did not escalate. Sorry, but pulling a gun on someone (in this described situation) just is not me. Guess I have a higher sense of security or whatever.
Another thing came to mind a while back, maybe he was a government type and had his equipment stolen. Knowing what was in store for him within his job, he was in panic mode. Who knows.
