How do you kick somebody out of a HOA? With the exception of voluntary HOA's, associations are a deed recorded obligation.

I would recommend she say all requests to the President need to be public, bring up your comments at the next meeting so they can be in the meeting minuets.

To all the posters, "I wouldn't live in a HOA". I live on a shared road with out any organization. We have folks building speed bumps others with myself included ripping them out. Cars/trucks doing lawn jobs around the speed bumps in the offender's yards. Then boards with nails being found. If we actually had a group vote, we would all abide. It's , I do what I want attitude I have an issue with.

This is what I mean in my previous post when I talked about true country HOAs. If you have more than a few close friends or relatives sharing a private road, you need a maintenance agreement and some kind of structure to implement it. Just don't let it morph into a full blown suburban style HOA and you'll be all good.

I would do this.
1. Create paperwork, hoops to jump through and documents to have on file. I would create a form that needs to be filled out and handed in at meetings....calls at home not tolerated thats your time.
2. issues need to be addressed at meetings and public. Have someone video tape the meetings so that you can "transcribe them".
3. set clear goals for what the hoa will address and will not address.
Clear up the confusion on what issues are addressable, and how to get action.

HOA's are like anything in life when you have to deal with other people.
Be honest. Talk to them face-to-face. Be firm. Do what you say.

There are crazies out there, and they thrive in the HOA environment. Ours isn't even a resident, she lives 80 miles away and rents her house here. She has sued the HOA 5 times. She was on the board but refused to participate. We finally arranged a special election and removed her from the board, but we still have two lawsuits in progress against her for libel and slander. The judge has ruled that the HOA will probably prevail so the request for summary denial was denied.

She sicced the Corp of Engineers on us, and they forced us to hire two management consulting companies to make sure we follow 'watershed guidelines'. The HOA couldn't grade the roads with an environmental impact report and management company approval. That raised our HOA fees $25 a month in 1 week.

Normal people, be polite and you will get along. Crazies in an HOA - just hope they don't fixate on you. Their sole goal in life is to make as many others as they can as miserable as they are.

I live in one of those yuppie HOA's , funny thing is they were so hung up on their rules and enforcement , Well someone didnt realize that the covenants had a sunset clause , after 30 years they had to be renewed and refiled with the county . I got a violation letter for my camper . When I sent them the paperwork showing that they were a HOA with no rules left to enforce , half the residents were determined to get them reinstated , the other half was totally against it . We now have a HOA with nothing to do . They tried , but found out that the legal fees could bankrupt the community pool they backed off
