Dwi DO apply to riding or driving horses. Police have arrested lots of people for operating anything on the roads while intoxicated.

What the heck is WRONG with you people? Where do I say ANYTHING at all about "DWI"? :anyone::anyone: I may just stop posting here as it seems there is some huge disconnect between the reality of what is posted and what members want to "argue" about.

Mate, it appears that you have confused the laws of another country with those of your country or State. In Canada (the UK, Australia, NZ, etc...) it is the Highway Act (or variations of the same) and pertains to a vehicle and the use of public roads. The vehicle does not specifically require a combustion "motor" for propulsion. In the case/story of the OP the vehicle was a buggy utilising a horse for propulsion, being driven in an erratic way. IOW the driver was not completely in control of his vehicle on a public road... the same law would apply to a bicycle, billy-cart or (perhaps) even roller skates if he was causing a danger to others/himself/property.

The driver and passengers where also charged with Provincial liquor law violations.

"The buggy driver, a 23 year old resident of the Township of Perth East has been charged with "careless driving" contrary to the Highway Traffic Act. The driver and the two male passengers in their early twenties were also charged with "having liquor in other than licensed premises, residence or private place" contrary to the Liquor Licence Act.

The latter charge probably means that they had open containers whilst the vehicle was in operation.

In short, you would lose the case for your clients.

I might. Depends on the jury and my powers of persuasion. I haven't had a traffic citation in a number of years, but I do enjoy taking them to court when/if the need arises. It saddens me to see that our lives have become so heavily regulated. Once had a prosecutor tell a jury panel in Voir dire that, "That he who represents himself has a fool for an attorney." My response, "The fool for an attorney saying is well traveled. However, since this is the only case I am working, I am one dedicated fool." Jury and judge got a good laugh, but still found me guilty and fined me $25.

You get off harping about DMV laws in Ontario, which apparently you are familiar with, get in a heated post trade with a well respected member and threaten to stop posting.
Reads like YOU got your feelings hurt and were going to take your toys and go home. Which would lower the level of arguments.

Haven't a clue about DMV laws in Ontario. The thing for me is this: There is all kinds of craziness in this world. Example: I'm living next door to a guy who's storing tons of stolen materials and the cops are powerless to stop it. When I read stories like the OP posted, I remember the silly things I did and most likely we all did at twenty-three-years-young. I just don't remember cops waiting around every corner trying to sour the fun. I don't want the government to "protect" me from every conceivable pitfall life throws in my path. It gets to the point where a man is no longer free. That is my opinion and as such it is debatable. As far as "well respected member," I did not realize there was a hierarchy observed by the members here and I apologize if I committed some act of blasphemy.

And arrests for DWI on bicycles, horses, etc. proves it doesn't matter.

DMV licences vehicles. Law Enforcement takes care of traffic enforcement.
